BACKGROUND
In 1969, the City and State of California (State) executed an agreement for the maintenance of State highway routes within the City. This agreement was superseded in 1988 to include specific responsibilities along El Camino Real and at the Interstate 280/Stevens Creek ramp area. On September 22, 2015, the City Council awarded Construction Contracts for four Hybrid Activated Crosswalk (HAWK) beacons along El Camino Real at the intersections of Alpine Avenue, Buchanan Drive, Morse Lane and Harrison Street (work was completed in 2017). City and State staff have been in discussion regarding adding these four locations to the current Agreement for Maintenance of State Highways within the City of Santa Clara.

DISCUSSION
Subsequent to the construction of the HAWK beacons, City and State staff agreed that it would be more efficient and responsive to delegate operations and maintenance of the HAWK beacons to the City. This is primarily due to the City being in closer proximity to the locations and already having experience with other HAWK beacons in the City. Upon approval, the proposed Amendment No. 1, which is attached for reference, the State will delegate operations and maintenance responsibilities of the HAWK beacons to the City of Santa Clara.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

FISCAL IMPACT
Currently, the City has budgeted approximately $2,000 per HAWK for annual operations and maintenance. The State will reimburse the City 67% of actual operations and maintenance costs...
