Consideration of Amendment No. 4 to the Agreement with Montoy Law Corporation for Legal Services for the Santa Clara Oversight Board

BACKGROUND
At the July 11, 2012 meeting of the Oversight Board to the Successor Agency for the Redevelopment Agency of the city of Santa Clara, the Oversight Board appointed Hilda Cantu Montoy, as the Oversight Board legal counsel. Since that time, Ms. Montoy has advised the Oversight Board at its meetings and has provided legal representation for the Oversight Board on an as needed basis.
DISCUSSION
As provided under the State of California Health and Safety Code section 34179 (j), as of July 1, 2018 all city oversight boards will be replaced by one countywide oversight board. Over the past 60 days Santa Clara Oversight Board has been active on matters related to the disposition of the North South parking lot parcel. Additional funds are needed for services as provided to the Santa Clara Oversight Board prior to its dissolution as of June 30, 2018. Amendment No. 4 adds $15,000 to the Agreement for a maximum total not to exceed contract amount of $235,000.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental organizational or administrative activity that will not request in direct or indirect changes in the environment.
FISCAL IMPACT
An administrative budget for the Successor Agency is not included as part of the Recognized Obligations Payment Schedule. Sufficient funds are available in City Manager's Office Authority Administration (program 1012) contractual services budget.
COORDINATION
This report has been coordinated with the Finance Department and City Attorney's Office.
