00:04:43 current Caltrans programs in Santa
00:04:44 Clara County.

00:04:57 District 4 so we have Lindsay Hart, We
00:05:01 have Nick Salai, who is the district 4
00:05:05 division chief, And we have Director
00:05:08 Tony Tavares.

00:05:17 us a presentation on some of the
00:05:18 programs Caltrans is working on in
00:05:19 Santa Clara County as well as go
00:05:20 through some of the itemsThat directly
00:05:21 affect the city of Santa Clara. I will
00:05:22 inviteThe director up to give his
00:05:26 presentation and afterwards he will be
00:05:28 available for any questions.

00:05:30 >>It evening.-- Good evening. Good
00:05:41 evening, Mayor Gillmor, It's a pleasure
00:05:43 to be here with you. I am Tony Tavarez,
00:05:48 I am the Caltrans bay area directorAnd
00:05:51 oversee the nine counties in the Bay
00:05:52 Area.We have a staff of just under 4000
00:05:57 employeesOperating budget of close to
00:06:02 $2 billion a yearAnd now with SP1 we
00:06:11 have quite a few more projects that
00:06:12 will be coming forward on the state
00:06:13 highway system as well as on the local
00:06:14 system. I did want to share with you
00:06:16 Where Caltrans is headed under our
00:06:17 leadershipMoving forward and we are
00:06:19 undergoing a transportation A
00:06:21 transformation at Caltrans.We have been
00:06:25 in the past the vehicle centric
00:06:26 organization primarily and I am taking
00:06:27 it to a different direction where I
00:06:29 want us to be more of a multimodal
00:06:32 Transportation organization moving
00:06:35 forward and looking at all modes of
00:06:36 transportation for all of our citizens
00:06:37 throughout the Bay Area, So I have a big
00:06:43 focus on pedestrian, bicycling, and
00:06:44 transit, on rail, on freight service
00:06:46 and other services out there as well.
00:06:52 Vehicles in freight are still very
00:06:53 important, obviously, we are the fifth
00:06:54 largest economy in the country, in the
00:06:55 world. We have a $2.2 trillion economy
00:06:59 so we want to ensure that we continue
00:07:02 to move freight and goods through
00:07:03 California across the nation.And in
00:07:09 addition, California's population is
00:07:10 currently around 40 million people, it
00:07:14 is expected to grow to 50 million over
00:07:15 the next 20 years. So questions, How do
00:07:19 we continue to support our vibrant
00:07:20 economy as well as the growth in the
00:07:21 city population? I would like to share
00:07:23 my focus areas with you this evening
00:07:31 With Caltrans in the bay area moving
00:07:32 forward. First of all, safety is our
00:07:33 highest priority. And we have been
00:07:34 doing quite a few different things when
00:07:38 it comes to safety, safety for the
00:07:39 motoring public, safety for industries
00:07:41 and cyclist, safety for employees as
00:07:42 well.We have embraced and we are
00:07:47 committed to the vision zero campaign
00:07:48 that is moving forward throughout the
00:07:49 stateIn the nation, and we have really
00:07:54 Embraced it as I mentioned, want to
00:07:55 bring this transportation system doubt
00:08:00 Caltrans currently manages into the
00:08:01 21st-century jury delivering projects
00:08:02 that will enhance safe for pedestrians
00:08:04 and cyclists as well as ensuring the
00:08:05 safety of our employeesAs they work on
00:08:06 the system.We are incorporating
00:08:10 complete Street featuresActive
00:08:19 transportation program concepts and all
00:08:20 of our rural and conventional highway
00:08:21 projects. We have adoptedAn act though
00:08:22 urban bikeway design guide to address
00:08:28 bicycle facilities on our system and we
00:08:29 are also coordinating and partnering
00:08:30 with Santa Clara to enhance pedestrian
00:08:31 safety in and around such as the leave
00:08:32 is -- Levi's Stadium and other areas in
00:08:37 the county. We are working very closely
00:08:41 With the autonomous vehicle industry as
00:08:42 well, we have several test and pilot
00:08:43 demonstration projects throughout the
00:08:44 state, Most notably in Southern
00:08:47 California we are workingWith the
00:08:52 southern states from California,
00:08:53 Arizona, New Mexico, and TexasOn truck
00:08:56 platoons, doing some vehicle to vehicle
00:08:57 autonomous testHere in the Bay Area on
00:09:00 El Camino Royale, we are doing some
00:09:04 Infrastructure technology testing as
00:09:05 well and we haveTwo of the autonomous
00:09:10 vehicle proving grounds in California,
00:09:11 one in Contra Costa and one in San
00:09:13 Diego County, so we are working closely
00:09:14 withFederal and Highway administration
00:09:17 and our local partners toDevelop and
00:09:21 move forward withMore autonomous
00:09:23 vehicle features.In moving in that
00:09:26 direction we have also movedTo a 6 inch
00:09:29 wide stripe on our highways, you may
00:09:33 have seen that on some of our projects
00:09:34 already, the 6 inch wide striping will
00:09:35 provideEnhance visibility for aging
00:09:49 motorists such as myself. I have a
00:09:50 difficult time seeing at night, it
00:09:51 helps me see a little bit better. It
00:09:52 also helps with the autonomous vehicles
00:09:53 and will allow them to stay within
00:09:54 their late and move more safely down
00:09:55 the roadway.With the six and striping
00:09:56 we are also looking at type XI retro
00:09:57 reflectOf signed paneling to be used on
00:10:01 our highways as well. So part of that
00:10:04 is also trying to reduce the amount of
00:10:05 lighting that we have on our signsAnd
00:10:07 the type XI actually uses a high
00:10:09 retroreflective video as I mentioned,
00:10:12 Allows the sign to be seen with just
00:10:13 headlights. And so we are able to
00:10:16 reduce the lighting, reduce the elect
00:10:17 initiallyIn reduced greenhouse gas
00:10:21 emissions on the system.In addition, we
00:10:30 are keeping our commitments when it
00:10:31 comes to Senate Bill one. I want to
00:10:32 keep our promises, the road repair and
00:10:33 accountability act of 2017Actually
00:10:37 brings $54 billion of additional
00:10:38 funding to California, about half of
00:10:40 that for Caltrans and the other half for
00:10:44 our local agencies such as the city of
00:10:45 Santa Clara and the counties as well.
00:10:49 Prior to SP1 being passed, we had $137
00:10:50 billionBacklog and maintenance work for
00:10:52 upstate that includes both the local
00:10:56 system as well as state highway system.
00:10:59 SP1 is going to double the amount of
00:11:00 work that we have on our roadways, and
00:11:05 we have a project here on El Camino
00:11:06 Riau which is a paving project, and
00:11:09 that is fully funded by SP1. Excited to
00:11:10 see that project
00:11:11 >>>Are we very excited?
00:11:12 >>Good.But SP1 also comes with some
00:11:17 performance measures that Caltrans is
00:11:19 responsibleTo address and responsible
00:11:25 to meet. So we are responsible to
00:11:26 ensure that 98% ofStatewide is in good
00:11:31 or fair condition. We have pledged to
00:11:33 address over 17,000 lane miles of
00:11:34 pavement over the next 10 years. We
00:11:36 have pledged to address an additional
00:11:39 500 bridgesSo that may be
00:11:45 rehabilitating or reconstructing or
00:11:46 rebuilding the bridges. We also have a
00:11:47 goal of ensuring that 90% of our
00:11:51 drainage systems, the culverts that
00:11:52 convey water from one side of the
00:11:53 roadway to the other, Are in good or
00:11:54 fair condition. We have also committed
00:11:58 to ensuring that 90% of our traffic
00:11:59 management since elements such as loop
00:12:04 detectors, CMS signs, traffic signals,
00:12:08 are operating in good condition moving
00:12:09 forward. So we have committed to
00:12:10 repairing almost 8, are operating in
00:12:11 good condition moving forward. So we
00:12:12 have committed to repairing almost 8000
00:12:13 of those elements over the next 10
00:12:14 years.Senate Bill one also requires
00:12:19 Caltrans to find efficiencies on an
00:12:20 annual basis, and so we've been asked
00:12:23 through the legislation the fine $100
00:12:24 million of efficiency on an annual basis
00:12:31 . Last year we are able to find $130
00:12:32 million that we reinvested back into the
00:12:33 highway system back into the
00:12:34 maintenance and preservation of that
00:12:35 system. This year we have a goal of
00:12:40 trying to find $200 million of
00:12:42 efficiencies that we want to put back
00:12:43 intoThe roadway system, the bridges,
00:12:47 the drainage systems and the TMS
00:12:48 elements.The third area I want to focus
00:12:59 on is really partnerships. I believe
00:13:00 partnerships is really the key to
00:13:01 getting anything done, and as I have
00:13:05 known in my 29 year career with Caltrans
00:13:08 , you cannot deliver a project by
00:13:10 single agency anymore. It takes a
00:13:11 partnershipOf multiple agencies, other
00:13:16 stakeholders, private industry at times
00:13:17 to deliver these projects.And it
00:13:20 literally does take a village to deliver
00:13:21 a transportation project. So I value
00:13:26 the relationships and partnerships that
00:13:27 Caltrans is built over the years here,
00:13:28 Michael -- my goal is to enhance the
00:13:31 partnerships and take it to another
00:13:32 levelAnd really be able to bring funding
00:13:35 combining our funding between measure
00:13:41 projects, local dollars, federal
00:13:42 dollars, state dollarsTo deliver more
00:13:43 and more transportation solutions for
00:13:45 our citizens. I am also committed to
00:13:47 improving communication between Caltrans
00:13:50 And our stakeholders. I want us to be
00:13:51 more proactive, I want us to have more
00:13:53 earlier involvement, Taking ownership
00:14:00 of our partners projects if it's on the
00:14:01 state highway system ensuring that we
00:14:02 treat those projectsAs if we are
00:14:03 delivering those projects are self in
00:14:04 house. In Santa Clara, we have had some
00:14:08 great successes with the ITWith Santa
00:14:11 Clara VTA and I'm committed to ensuring
00:14:16 that IT moves forward and continues
00:14:17 forward for many years to come.We've
00:14:22 had some, We are working on some great
00:14:28 projects, obviously delivering the
00:14:29 Santa Clara 101 express lanes project
00:14:33 Which ties also into the San Mateo
00:14:34 County 101 managed lanes project,Both
00:14:37 of those have started construction in
00:14:38 early March, those areFantastic
00:14:41 projects, those are SP1 fundedAs well
00:14:44 as other local and private funds on
00:14:45 those projects as well.We are working
00:14:47 very closely with Santa Clara County on
00:14:51 the 101 Mayberry Road improvement
00:14:52 project, The one one thing you wrote
00:14:53 improvementProject, and also in the
00:14:57 South County, one 125Interchange project
00:15:00 , which would be in SB oneTrade
00:15:03 corridors enhancement project.So I'm
00:15:10 also interested in exploring other
00:15:14 congestion relief strategies moving
00:15:15 forward. We have talked about or I have
00:15:17 talked about some of these express lane
00:15:18 projects. I would also likeTo explore
00:15:20 the opportunities of maybe having
00:15:23 dedicated transit lanes on some of our
00:15:24 system bus rapid transit, more
00:15:27 involvement of that, reversible lanes
00:15:28 where it is feasible to do soAnd
00:15:32 additional express lanes and moving to
00:15:33 an HOV 3+In the future.One of my
00:15:39 biggest concerns looking at the bay
00:15:40 area is we've pretty much built out our
00:15:47 state highway system, and so I don't
00:15:48 believe we can continue building
00:15:49 ourselves out of congestion. We need to
00:15:50 get very innovativeAnd smart on how we
00:15:51 deal with congestion in the Bay Area.
00:15:57 Another area of concern for usAt
00:16:00 Caltrans and I am sure for you as a city
00:16:04 Is dealing with littering and the
00:16:05 homeless situation.Bay area has around
00:16:07 40,000On housed citizens, second only
00:16:15 to Los Angeles, which has 55,000 people
00:16:17 , there's about 140,000 on how citizens
00:16:20 in California today. Last year Caltrans
00:16:25 spent over $7 million dealing with
00:16:30 letter and -- litter and dealing with
00:16:31 the legal encampments alone or highways
00:16:32 the. We've had some very successful
00:16:35 Projects with some of the larger cities
00:16:40 in the Bay Area, San Francisco,
00:16:41 Oakland, and now working with San Jose
00:16:44 On some programs will provide land on
00:16:45 parcels the state right-of-way and they
00:16:49 are able to put together like a
00:16:50 navigation system or community cabin
00:16:51 system and they are able to take these
00:16:57 on how citizens, put them through a
00:16:58 program, give them life skill training
00:16:59 And then also helpFind affordable
00:17:03 housing. So it's been a very successful
00:17:04 program in San Francisco and Oakland, I
00:17:06 pledge that any of the individuals who
00:17:08 successfully complete thatProgram I
00:17:11 will have 20 positionsWaiting for them
00:17:13 to hire themAs Caltrans employees if
00:17:19 they do want that. I pledge those
00:17:20 positions to them.So how are we
00:17:30 changing the way we do business? I
00:17:31 think moving forward, some the things
00:17:33 that we are really looking at is
00:17:35 looking at the system more holistically
00:17:38 Got taking an asset management approach
00:17:39 and really looking atThe four asset
00:17:45 groups that Senate Bill one is focusing
00:17:46 on, and that's our pavement, our bridges
00:17:48 , Our drainage systems, and our
00:17:50 transportation management system
00:17:51 elements.Caltrans has developed a 10
00:18:00 year shop plan, which we call the state
00:18:01 highway system management plan, and in
00:18:02 that plan we have actually laid outAll
00:18:05 the projects we plan on doing over the
00:18:06 next 10 years, and we are sharing that
00:18:07 withAll of the nine counties in the Bay
00:18:08 Area, sharing that with the ETA, with
00:18:11 all the cities and counties so there's
00:18:13 opportunities for the measure programs
00:18:19 to partner with us if there are other
00:18:20 projects they would like to combine
00:18:21 funding or combine project limits with
00:18:22 us, So that's a great opportunity there
00:18:25 I think one of theChanges that we are
00:18:30 doing now is we are not looking at
00:18:31 these projectsIn a silo approach where
00:18:35 we are just doing pavement projects, we
00:18:40 are just doing bridge projects, we are
00:18:41 actually combining these different
00:18:42 assets together and doing more of a
00:18:46 total project cost of this way we don't
00:18:47 pave the road and then come back and
00:18:48 replace a culvert later and it just
00:18:49 causes more inconvenience for the
00:18:52 public, for the travelers kind causes
00:18:53 more inconvenience for our partners
00:18:54 such as you as well.So the real big
00:18:59 change moving forward, not just the
00:19:00 asset management, each district is
00:19:02 being provided in allocation on an
00:19:04 annual basis for projects. If we can
00:19:06 get creative here in the Bay Area and
00:19:09 work closely with all of you, Any money
00:19:11 that we saveDoesn't go back to
00:19:21 Sacramento, it doesn't go back to the
00:19:22 state highway account. It actually can
00:19:23 stay here in the Bay Area and get
00:19:24 reinvested into additional project. So
00:19:25 that's the exciting part on the
00:19:26 exciting new way of doing business with
00:19:27 asset managementIn the direction we're
00:19:30 headed in Caltrans today.Obviously
00:19:33 there is still accountability with that
00:19:35 With those funds, and we have to work
00:19:36 throughThe California transportation
00:19:41 commission, but the great thing is as
00:19:42 those funds can stay here in the Bay
00:19:43 AreaAnd be reinvested into additional
00:19:44 projects.That's my focus areas moving
00:19:55 forward with Caltrans in the bay area.

00:20:23 that. I just have a question, I mean,
00:20:25 it's really, it's good to see aboutThe
00:20:28 projects that are in the works, and I
00:20:32 was just wondering like for instanceThe
00:20:35 U.S. 101 Delacruz Trimble Road
00:20:38 interchange and frankly all the other
00:20:42 projects, is there somewhere where we
00:20:43 can go to seeExactly what's going to
00:20:44 happen so that we can let our
00:20:49 constituents know as we hear of
00:20:50 questionsAnd you just let them knowWhat
00:20:54 exactly is going to happen?
00:20:58 >>Yes, most definitely. We do haveThe
00:21:04 state highway management system plan on
00:21:05 our website and it lists all the
00:21:06 projects there, soThat would be a first
00:21:07 step. Also Nick Ciletti, our division
00:21:12 chief for project management, a handle
00:21:13 Santa Clara County. Be a great this
00:21:14 point for specific projects or specific
00:21:19 items within those projects that you're
00:21:20 interested in. He could at that
00:21:21 information to share with your
00:21:25 constituents as well.
00:21:26 >>Wonderful, okay, thank you. And then
00:21:27 regardingIf the partnering regarding
00:21:29 the litter and the homeless, could you
00:21:33 just go back over that again? You
00:21:34 mentioned thatYou've been working with
00:21:35 San FranciscoAnd Oakland. You have
00:21:40 plans to do the same similar down here
00:21:41 in the South Bay?
00:21:46 >>I do, so we are working right now
00:21:47 with Merl Accardo's office in San Jose,
00:21:48 love to expand that to Santa Clara as
00:21:49 well and other towns and cities in
00:21:52 Santa Clara County. We've identified 10
00:21:53 parcelsSo far in the San Jose area that
00:21:55 we are working with the mayor's office
00:21:57 To clear and be able to move forwardWith
00:22:01 tiny homes or any other facilities that
00:22:05 They feel are appropriate for temporary
00:22:06 and emergency shelter.
00:22:08 >>Okay, great. But with the goal of
00:22:10 Employing peopleThat will eventuallyBe
00:22:14 able to use those?
00:22:15 >>Exactly. So being Caltrans, we have
00:22:20 limited resources for a transportation
00:22:25 agency. I don't have social services, a
00:22:26 lot of those programs. We like to
00:22:32 Partner with the cities and counties
00:22:33 that have those other programs
00:22:34 associated to them. We are able to
00:22:35 bribe them some resources,We are able
00:22:37 to problem some parcels where they can
00:22:38 do the housing then if they have a
00:22:39 program where there is, if a person is
00:22:42 drug or alcohol dependency if they can
00:22:43 get through that whole program
00:22:44 successfully I will pledge 10 to 20
00:22:46 positions for this area to hire them
00:22:51 and so they can stay in this area can
00:22:52 be employed and get back into society.
00:22:53 >>Great. So you're working withOutfits
00:22:54 like downtown streets?Great.
00:22:57 >>Downtown streets and other programs.
00:22:59 >>That's really good to hear. And then
00:23:01 when you mentionedAbout the asset
00:23:03 managementAnd being able to save any
00:23:07 kind of funding and through creative
00:23:12 ways, you have any examples of what
00:23:13 those creative ways might be?
00:23:16 >>So many times Caltrans comes through
00:23:17 and does a project, let's say it's a
00:23:18 paving project, And we don't know that
00:23:20 VTA or we don't know thatThe city is
00:23:24 also doing a project in a similar area
00:23:25 or the same geographic post my limits
00:23:27 for the project. Opportunities of us
00:23:34 combining our projects together, doing
00:23:35 one project, we bring some funding, you
00:23:36 bring some funding, so weBoth get a
00:23:38 savings in our funding, more of an
00:23:43 economy of scale producing these
00:23:44 projects and then we have savings that
00:23:45 we can reinvestAnd to other projects.
00:23:46 That's a little differentWay of doing
00:23:51 business for Caltrans, we haven't done
00:23:52 that in the past, and soI really want
00:23:54 to enhance those partnerships and look
00:23:56 for those opportunities wherever
00:23:57 possible.

00:24:05 evening, Director Tavarez.I represent
00:24:09 Santa Clara on the VTA board. We
00:24:10 appreciate that we now do have a
00:24:11 Caltrans presenceIn Santa Clara County,
00:24:15 because I think it's really helped to
00:24:16 build the communication to get an
00:24:20 understanding when people are
00:24:21 physically year at least a couple of
00:24:22 days a week to see was going on.And I
00:24:24 feel for youAnd we met your predecessor
00:24:29 couple of years ago on the VCA board,
00:24:30 and I think as you said, Caltrans is
00:24:34 not a social services agency, and yet I
00:24:35 think everybody who has been anywhere
00:24:38 near a freeway in the whole Bay Area
00:24:39 has seenThe very challenging and
00:24:41 difficult situation whereWe now have
00:24:44 folks that are living all overThe
00:24:47 Cloverleaf's, so just even on the
00:24:51 embankments, oh my gosh, how can
00:24:52 somebodyLive there? And I know that I
00:24:53 have heardThat. We have had in the past,
00:25:03 things of been cleaned up and almost
00:25:04 immediately you've got another problem.
00:25:05 I think it's greatThat one of the
00:25:07 challenges is finding a place and I
00:25:08 know other cities are looking at also
00:25:09 doingSafe parking and those, because
00:25:11 thereAre people I've mentioned who have
00:25:15 seen a lot of care words or RVs or
00:25:18 trailers or whatever that are parked.So
00:25:22 I thank you for your efforts in that
00:25:23 area and I think it is something that
00:25:24 everyGovernmental and community
00:25:28 neighborhood group has to come together
00:25:29 to really be able to solve that. But
00:25:36 for, particularly the issue that has
00:25:37 been of interest in the attic area, I
00:25:39 want to say I applaud you have strictly
00:25:41 the work on El Camino seems to be
00:25:42 progressing. I think that, it's gone
00:25:44 much fasterThen I thought it would, and

00:27:52 lot of different technology this point,
00:27:53 we're looking at a damn to have ramp
00:27:54 metering, we are looking at a lot of
00:27:55 different, congested, the express Lane
00:27:56 technology also in congestion pricing
00:27:57 on some of our roadways. I mentioned
00:27:58 that I would also like us to start
00:27:59 exploring the opportunitiesOf possibly
00:28:00 having some dedicated transit lanesOn
00:28:01 our facilities that could have a bus
00:28:04 rapid transit system to actuallyEntice
00:28:07 folks to get out of their single
00:28:08 occupantVehicles and into some type of
00:28:10 multimodalTransportation option.
00:28:18 Councilmember O'Neill mentioned that
00:28:19 there are corporate buses that are
00:28:20 going up and down our roadways today,
00:28:22 so we see the Google buses, we see the
00:28:23 Facebook buses, they are out there,
00:28:28 they have already figured it out that
00:28:29 we need to move more people in a much
00:28:30 more efficient mannerAnd getting into a
00:28:32 vehicle by ourselves is no longer the
00:28:33 way that we can do bizThis moving
00:28:36 forward, and so any type of new
00:28:37 technology, Whether it's autonomous
00:28:40 vehicle technology, whether it's a.have
00:28:43 ramp metering, whether's other
00:28:44 electronic type ofComputerized type of
00:28:50 technology, we are open with that, we
00:28:51 are working closely with UC Berkeley in
00:28:52 the past gram, UC Davis and many of the
00:28:53 other academicColleges and universities
00:28:57 to help us with that. We are also
00:29:00 members of IT is America, we were
00:29:01 closely with, and we are trying to
00:29:05 bring some of those ideas and
00:29:06 innovative solutions to California.

00:29:11 Camino beingCaltrans, they control all
00:29:14 the light signalingWhere is we control
00:29:17 the other way around. So how do we
00:29:18 coordinateBackground make them so we
00:29:25 make them better and reduce some

00:29:28 opportunities for us to synchronizeThe
00:29:31 traffic signals together. We have a
00:29:32 traffic management center in Oakland
00:29:33 that we monitor all our traffic signals
00:29:36 throughout the nine counties, but I
00:29:37 think there's an opportunity for us to
00:29:38 partner with the city of Santa ClaraAnd
00:29:39 maybe have some delegated maintenance
00:29:40 work where you can ask a control the
00:29:42 signals and if you needCertain direction
00:29:45 all in green to keep the flow of
00:29:50 traffic moving, I think we've got some
00:29:51 great opportunities, would love to
00:29:52 enhance that partnership with the city
00:29:53 and see where we can go with that.

00:34:11 more flexibility on who they can
00:34:12 contract with so we workedFor the
00:34:13 cities of the counties to do these
00:34:14 programsAnd from there they would select
00:34:20 whether it's a church group, there's
00:34:21 downtown streets, whether it's another
00:34:22 program or organization likeThat, and
00:34:24 from basically going through that
00:34:27 entire program, I pledge a number of
00:34:28 positionsFor each city that if we have
00:34:32 successful candidates that complete
00:34:33 that programAnd they are drug-free,
00:34:38 alcohol free, we will provide them the
00:34:39 opportunity for employment with
00:34:40 Caltrans.

00:36:57 report. Back on May 7, we, I brought
00:37:00 forwardTo the Council a discussion on
00:37:04 the measure capital in workPlan. Just
00:37:08 to recap for those who may have missed
00:37:09 that meeting or want a refresher, the
00:37:12 Council did take action.On the size of
00:37:14 the committeeForEvaluating are doing
00:37:20 outreach to the communityOn putting a
00:37:28 charter review committee together, the
00:37:29 Council agreed on a seven member
00:37:30 committee. The Council agreedThat they
00:37:33 would appoint somebody from each
00:37:36 district and there would be an
00:37:42 application process similar to the
00:37:43 application processes that we have for
00:37:44 awards and commissionsAnd one of the
00:37:48 main points of discussion was around
00:37:49 the time lineFor this work plan, we
00:37:54 came out with a May 7 meeting was to put
00:37:59 An item on the November general
00:38:00 election ballotThat would serve to
00:38:04 amend the charter such that it would be
00:38:07 in compliance with whateverElection
00:38:09 system the community feels appropriate.
00:38:14 Since the May 7 meeting,The plaintiffs
00:38:17 in the see vRA lawsuitHave taken some
00:38:20 action with regards to the appeal that
00:38:23 hasSince then acceleratedThe timeline
00:38:28 that we would need to take action for
00:38:33 the charter review committee. And so
00:38:38 What the item before you tonight is to
00:38:40 go back and look at the alternative
00:38:43 work plan that we presented on May 7,
00:38:45 Which would then place the itemOn the
00:38:49 March ballot, not the November ballot.
00:38:54 So really there is no change relative to
00:38:59 The work plan that we presented, we
00:39:00 presented two work plans on May 7, we
00:39:02 presented the work plan that would
00:39:05 allow us to put it on the March ballot
00:39:06 and we presented the work land that
00:39:07 would put it on the November ballot.
00:39:12 The only recommendation that we are
00:39:13 coming back to the Council for approval
00:39:14 for is to reconsiderAnd select the work
00:39:16 plan for the March ballot because of
00:39:18 the accelerated timelineThat this see
00:39:22 vRA natives have laced on the city for
00:39:25 the appeals process.Looking at that,
00:39:32 There still going to be a very good
00:39:33 opportunity for robust public outreach
00:39:37 In both plans, we didHave ample time
00:39:41 for the charter review committee toHold
00:39:43 several meetings with the communityTo
00:39:47 Gage and take a pulse onThe, Whether
00:39:55 the community likes the current district
00:39:56 land or they would like to do
00:39:57 something differentWith the arrangement
00:40:01 of districts or no districts at all,
00:40:03 and so even with the accelerated work
00:40:05 Land that would put it on the March
00:40:06 ballot, There are still several
00:40:09 meetings for public outreachWith the
00:40:11 community. So that's pretty much itIn a
00:40:14 nutshell. I am available for any
00:40:17 questions. There is one very strong
00:40:19 concernOr kind of something that I
00:40:22 would like toAdvocate very strongly
00:40:25 with each councilmemberIs that with the
00:40:29 June 28 deadlineFor applicationsFor the
00:40:33 charter review committee, We don't have
00:40:36 much wiggle room beyond thatTo appoint
00:40:38 a committee.So if we do not receive
00:40:43 enough submissions from each district
00:40:46 Because the desire of the Council was
00:40:47 to have oneCharter committee member
00:40:51 from each district with one at large,
00:40:59 That if any district does not have
00:41:00 sufficient applications than the
00:41:01 councilmember from that districtWould
00:41:05 need to appoint somebody from that
00:41:06 district. I would very highly encourage
00:41:07 the councilmembers reach out toThe
00:41:08 community in their districtsAnd
00:41:11 encourages many folks who are
00:41:12 interested to applyThrough the charter
00:41:13 review committee so we don't find
00:41:17 yourself in a situation where we do not
00:41:18 have enough applicants from any district
00:41:22 in which in that case the
00:41:23 councilmember from that district would
00:41:24 need to find somebody and appoint them.

00:46:13 volunteer reserve firefighter in 1982.
00:46:18 You are hired full-time in 1984 and
00:46:22 steadily rose through the department
00:46:23 ranks until your appointment as the
00:46:24 citiesSixth Fire Chief in 2012, is that

00:46:32 >>Since we were full-time in 1949.
00:46:35 >>That makes sense. You have led the
00:46:36 fired department to think strategically
00:46:42 about emergency services which led, and
00:46:43 I know you had a huge part in this to
00:46:46 receiving an international
00:46:47 accreditation from the commission on
00:46:50 fire accreditation international
00:46:51 developing a five-year strategic planTo
00:46:54 align with city Council goals and
00:46:55 enhancing the officeOf emergency
00:46:56 services, which isCompletely been
00:46:59 revamped. So thank you for that. Chief

00:47:52 appreciate that. I did start long time
00:47:53 ago got 35 years ago as our city was
00:47:54 transitioning from the oldAgricultural
00:47:55 roots to a high-tech economy. I think
00:47:56 we were just closing the last dairy in
00:47:59 town on the north end of town when I
00:48:00 got started.As the city grew, our
00:48:05 progressive fire department adapted
00:48:06 over time to provide the best service
00:48:07 prior If possible, we are the first
00:48:11 sitting county to have a hazardous
00:48:12 response in, we added paramedics our
00:48:13 department in expanded our technical
00:48:17 rescue capabilities we are now a full
00:48:18 service department. I/O debt of
00:48:23 gratitude to those who have served
00:48:24 before me. My desire is Fire Chief when
00:48:25 I was appointed back in 2012 was to
00:48:26 build upon their successes and help
00:48:28 shape a department for the future.I
00:48:32 have been blessed to have the
00:48:33 opportunity to work in a very noble
00:48:34 profession, firefighting.But it's more
00:48:36 importantly,I'm fortunate to work for
00:48:41 great employer, the city of Santa Clara.
00:48:43 The city of Santa Clara, takes great
00:48:50 care of its employees. I benefited
00:48:51 tremendously from that. The city has
00:48:52 provided me with the means necessary
00:48:53 for my wife Barbara and I, Who is here
00:48:54 tonight, to raise our four children and
00:48:55 needs community and enjoy a wonderful
00:48:56 life.For that I will be eternally
00:49:00 grateful. I think my wife Barbara for
00:49:07 her love and support over my career,
00:49:08 especially during my tenure as Fire
00:49:09 Chief I keep telling her every day she
00:49:10 is married to an incredibly lucky man.
00:49:12 Any accomplishments or experience in my
00:49:16 career are the direct result of the
00:49:17 work performed by our department staff.
00:49:18 My command staff specifically Deputy
00:49:28 Fire Chief JD man and Deputy chief
00:49:29 Jeremy Ray have provided direct support
00:49:30 and leadership which has allowed us to
00:49:31 accomplish so much as a management team.
00:49:32 My battalion chiefs, fire marshal
00:49:33 Tomlin in the hazmat division staff,

00:50:06 challenges together and enjoyedTeam

00:50:17 been able to modernize our practices

00:53:57 recognition of the Norcal girls fire
00:53:58 campHeld at Santa Clara fire Department
00:54:03 on May 4 and May 5, 2019.Hold on one
00:54:14 second, let me get this one out. Okay.
00:54:15 SoThe city Council would like to
00:54:19 recognize the Norcal women in the fire
00:54:20 serviceIn the Santa Clara fire
00:54:23 department for their partnership in
00:54:24 hosting the Norcal first alarm girls
00:54:31 fire camp in Santa Clara on May 4 and
00:54:32 five. Norcal women in the fire service
00:54:38 was founded by a small group of female
00:54:39 firefighters. If you notice, there was
00:54:40 a giant group of female firefighters
00:54:41 that walked into the Council chambers
00:54:42 tonight to mentor and inspire current
00:54:43 and future womenIn the fire service.
00:54:45 Santa Clara fire Captain Jen Panko is
00:54:50 one of the founding board members and I
00:54:51 see Jen in here for her to minute, so I
00:54:52 would like to inviteChief Kelly, see,

00:54:58 the girls fire campAnd introduced the
00:55:00 camp incident commander.
00:55:01 >>We are very proud to partner with the
00:55:08 Norcal fire services Association to put
00:55:09 this camp onIn our town. It's part of
00:55:14 an expanding recruitment outreach
00:55:15 strategy we haveTo bring the fire
00:55:16 department job to people who maybe
00:55:19 haven't thought about thisAs their
00:55:21 profession, maybe haven't heard about
00:55:24 firefighting as a choice, and so we
00:55:28 partner with them to bring at the high
00:55:29 school girls in our community.Here

00:55:49 leaders. As the chief said my name is
00:55:50 Jen Panko and I am a captain with the
00:55:51 fire departmentAnd I had the
00:55:53 extraordinary experience of being the
00:55:54 incident commander for the recent girls
00:55:55 fire camp that our fire department in
00:55:58 partnership with the Norcal women in
00:55:59 the fire departmentHosted last month.
00:56:03 The incident commander has the ultimate
00:56:04 responsibility of running the event,
00:56:06 ensuring that all the resources are
00:56:07 provided, That the personnel are safe
00:56:10 in the event comes to a successful close
00:56:12 and I had a lot of help in making all
00:56:13 that happen.If you'll bear with me I'm
00:56:16 going to describe what the camp is about
00:56:18 In the fire department.It was founded
00:56:22 last year by small group of us from a
00:56:23 fewBay Area fire department
00:56:26 simultaneously in the same path to find
00:56:27 a wayFire camp in our own agencies. One
00:56:36 of the missions of the girls fire camp
00:56:37 is that it be planned, led, instructed,
00:56:38 and staffed entirely by female
00:56:39 firefightersParole modeling purposes.
00:56:40 Since the national average of female
00:56:44 firefighters is only 45%, one
00:56:45 department is the number of female
00:56:46 firefighters that can pull this off.
00:56:51 Therefore there is a need for the fire
00:56:52 departments to partner with Norcal
00:56:53 women in the fire service to host these
00:56:54 camps. Ghosting fire departmentsProvide
00:56:59 the facilities and the Norcal women
00:57:00 provides the personnel and the camp
00:57:01 program. The goal is for the camp to
00:57:04 rotate around the Bay Area to be hosted
00:57:05 by different fire agencies twice a year
00:57:08 . Fremont fire Department hosted the
00:57:09 first camp last fall in the Santa Clara
00:57:10 fire department generally office Is
00:57:15 generously offered to host camp in our
00:57:16 city in the next month. The next camp
00:57:19 will be hosted this fall by the San
00:57:20 Francisco fire Department on the 28th
00:57:21 and 29th.For upcoming information, you
00:57:24 can follow the camp atNorcal fire
00:57:28 camp.com. The mission of the girls camp
00:57:35 is to expose young women to the tools
00:57:36 of the fire service early and empower
00:57:37 them to have the comp is to pursue any
00:57:39 career that they want including the
00:57:40 career as a firefighter. Engine of the
00:57:41 camps is to be a long-range recruitment
00:57:46 Tool to diversify fire department and
00:57:47 increase the number of female
00:57:48 firefighters. At the Santa Clara account
00:57:51 we had a staff of 115 female
00:57:52 firefightersRepresenting 30 fire
00:57:56 departments from all over the Bay Area,
00:57:57 the state and from as far as Alaska,
00:58:00 Texas, and Hawaii. We had 52 campers
00:58:01 attend ranging from 14To 18 years old,
00:58:04 representing 32 citiesSeveral of the
00:58:09 campers are right here from Santa Clara
00:58:10 and two of these young ladies are with
00:58:11 us tonight.As well is inspiring these
00:58:16 young campers, those of us that are
00:58:17 already fired upFighters are
00:58:20 reinvigorated by our participation in
00:58:21 these camps. It is a very powerful
00:58:25 experience as a woman to be surrounded
00:58:26 by 115 firefighters as each of us has
00:58:28 grown accustomed to being the only woman
00:58:30 In our station and on our shift or even
00:58:36 in our department and some
00:58:37 organization. Upon first meeting at the
00:58:38 camp, all of us see these amazing women
00:58:42 and realize that we are all connected
00:58:43 by a common determination make a
00:58:44 difference in the fire service. So most
00:58:47 of these campers had no prior exposure
00:58:48 to the fire service and during the camp
00:58:52 they got to try on turnout gear for
00:58:53 firefighting, flow water from fire
00:58:54 arrows, time 65 feet up the aerial
00:58:58 ladder, cut opening cars with the jaws
00:58:59 of life and cut simulated roofs with
00:59:03 Axes and chainsaws. They also obtain
00:59:04 their CPR certification during the camp
00:59:05 . The camp staff got to see with our
00:59:06 own eyesTransformation confidence in
00:59:09 these young women from the start of camp
00:59:10 to their graduation.The matter what
00:59:12 they end up deciding to do for a career
00:59:16 , These young women left the camp
00:59:17 knowing and proving that they could do
00:59:18 more than they came into the camp
00:59:19 thinking that they could.Before we show
00:59:31 you a four minute video recap of the
00:59:32 camp that was provided by the VR fee
00:59:33 team at the Alameda County fire
00:59:34 department I would like to say if you
00:59:35 think use and introduce a few people.

00:59:38 was instrumental in encouraging him to
00:59:39 orderThe Santa Clara fire department
00:59:41 does this camp and supporting your
00:59:42 female firefighters to take time out of

00:59:49 help staff the camps. He but the idea
00:59:50 in my head to pursue hosting camp here
00:59:51 and it would've happened in Santa Clara
00:59:52 without his inspiration. Thank you

01:00:23 critical role of camp administration
01:00:24 and graciously and tirelessly managed
01:00:25 the task of registering the campers
01:00:26 from the original list of 97 down to
01:00:30 the 52 who attended. Ada faced her own
01:00:31 fears during the camp and climbed the
01:00:32 aerial ladder herself.Good job, Ada.

01:00:43 automotive gave us permission to use
01:00:44 the city employee parking lot
01:00:45 surrounding the courtyard to park all

01:00:57 to run the camp workstations and
01:00:58 sharing their fire station with 170

01:06:50 models of women that we might never
01:06:56 have been exposed to before and also
01:06:57 exposed to an occupation we've never
01:06:58 explored before. My favorite part of
01:07:00 the camp was using the Jaws of life to
01:07:01 cut off the roof of the carAnd it was
01:07:03 very exciting to learn how to use it.

01:07:38 is part of a long-term recruitment
01:07:39 Diversification effort in the short
01:07:41 term with budget approvalThe Santa
01:07:47 Clara fire department is getting ready
01:07:48 to launch a recruitment campaign with a
01:07:49 new strategy to diversify our applicant
01:07:50 pool. Strategy includesTargeted social
01:07:52 media marketing using that he is
01:07:55 starting her own personnel. We are set
01:07:56 to launch our newCampaign on July 1
01:08:00 with an application period for October.

01:08:17 well, but I had the opportunity to
01:08:18 attend the graduation but before the
01:08:19 graduationI was observing the aerial
01:08:20 laddersThat the chainsaws, thePutting
01:08:27 out the fires, I have just, I was amazed
01:08:30 , I didn't expect that, I know that
01:08:33 Captain Panko, you talked aboutThe
01:08:35 Fremont girls campAnd I was excited
01:08:40 that we had it in Santa Clara, but when
01:08:41 I went out there and saw, it was at the
01:08:44 end of the camp, so I sawJust the
01:08:46 passionIn theConfidence in the girls,
01:08:53 and they were fierce by the end ofThe
01:08:55 week and and they had been there for
01:08:58 two full days and they had so much
01:08:59 energyAnd there was one clip of the
01:09:01 girls screaming. They were screaming
01:09:05 the whole time I was thereI don't know
01:09:12 whether it was their leader screaming
01:09:13 or they were screaming, but there was a
01:09:14 lot of noise, and it was suchHigh
01:09:15 energy atmosphere and so funAnd it was
01:09:19 just so nice that they were able to see
01:09:21 Their role model'sTo have womenIn a
01:09:25 traditionally male dominatedFire
01:09:28 service to be able to see the womenAnd
01:09:30 some of the women firefighters that I
01:09:33 met especially there was one from San
01:09:34 Francisco,She was amazing, just to hear
01:09:36 their storiesOf being the only women in
01:09:38 their departmentOr the only women ever
01:09:42 in the department, just some of the
01:09:43 storiesThe attitudes are so great and
01:09:48 the fact that most of them volunteered
01:09:50 To be there, so they leftWhatever state
01:09:54 they were from and they all justTook
01:09:57 their own time, spend their own money
01:09:58 to come upAnd be roll models for the
01:10:00 young girls was amazing. So I'm
01:10:04 positive you're going to get future
01:10:05 firefighters out of that camp and I am
01:10:07 hoping we can do more of that and I'm
01:10:08 glad to see that your recruitment
01:10:11 process is going to do more outreach,
01:10:13 Because that, if you could see it, if
01:10:16 we do it again, everyone has to goAnd
01:10:19 really witnessed that. It was just an
01:10:23 amazing sight. So thank you, and thank
01:10:24 you to your team and everyone butThat
01:10:25 put that together. That was a huge
01:10:27 Amount of work to put that together, but
01:10:31 you all did it with smiles on your face
01:10:33 And great attitudes and fun, And I can
01:10:39 see that there is a lot of benefit that
01:10:40 came from that. So thank you very much.
01:10:42 Councilmember Watanabe, did you want to
01:10:43 say anything?
01:10:50 >>I will just say a couple of words.
01:10:51 Thank you, Jen, for the program and
01:10:52 thank you to all the female
01:10:53 firefighters that gave their timeTo put
01:10:56 this event together and all the
01:10:57 collaboration from all the different
01:10:58 departments, it just showsAgain to be
01:10:59 successful you need to have everybody
01:11:00 engaged, And it was so wonderful to see
01:11:03 how many people came on board. I had
01:11:07 seen Assistant chief winter afterwards
01:11:08 and I asked him how'sSarah did after
01:11:12 her first day and he said she came home
01:11:13 and just crashed.So it definitely had
01:11:20 an impact on the first day, but it was
01:11:21 wonderful to be out there on Sunday and
01:11:22 see everybody participatingAnd all the
01:11:23 girls engaging in excited but even at
01:11:24 the end after two days and at the
01:11:27 graduation they still had so much energy
01:11:33 And put together their everybody had
01:11:34 like a little chant, I guess, for each
01:11:35 group.
01:11:36 >>Leave itTo a bunch of high school
01:11:38 girls to come up with cheers. I don't
01:11:40 know if I would do thatAt the boys
01:11:45 camps. We cheer after the council
01:11:46 meetings, did you know that? Not going
01:11:47 to tell you what our chair is.
01:11:53 >>But it's clear to see why the program
01:11:54 is so popular and why there is a
01:11:55 waiting list and now going forwardThere
01:11:56 is already I think the camp is probably
01:11:58 full based on the amount of peopleThat
01:12:01 were on the waiting list. So
01:12:02 congratulationsAnd we look forward to
01:12:03 continuingTo support the program.
01:12:09 >>Is there an age limit for the camp?We
01:12:14 would like to the do the camp for all
01:12:17 different age ranges, the most reporting
01:12:19 Part was after the camp getting the
01:12:21 emails from the parentsAbout the camp.
01:12:29 Many of the girls have said they wanted
01:12:30 to be firefighters.

01:12:39 >>Okay, our next special ofOrder
01:12:41 business is the recognitionOf the every
01:12:44 15 minutes planning committee. SoThe
01:12:51 every 15 minutes planning committee team
01:12:54 consisted of dedicated employeesFrom
01:12:56 the police department and Santa Clara
01:12:58 high school. The Santa Clara Police
01:13:02 Department and the Santa Clara unified
01:13:05 school district for hosted every 15
01:13:06 minutes which was a two day drunk
01:13:08 driving and distracted driving
01:13:09 prevention program at Santa Clara high
01:13:12 school which took place May 2-3, 2018.
01:13:17 So on May 2, a fatal car collisionWas
01:13:19 staged on the football field. Emergency
01:13:22 response was fast-pacedAnd very
01:13:24 realistic. Students witnessed firsthand
01:13:29 and parents were notified that their
01:13:30 childHad been killed as a resultOf a
01:13:33 DUI collision. On May 3, a mock funeral
01:13:37 was held, speakers included the
01:13:40 students parents, chaplain Ryan Wright,
01:13:44 chief Mike Sellers and principal
01:13:45 Gregory Shelby.The two day event
01:13:51 created a realistic understanding of
01:13:52 the impact on people involvedIn
01:13:54 alcohol-related and distracted driving
01:13:56 Data collisions and served as a
01:13:58 powerful tool to create awareness. I
01:14:07 know councilmember Watanabe you
01:14:08 probably have a few things to say,
01:14:09 we'll probably hold those just for a
01:14:10 minute since your daughter was involved
01:14:11 in that as well and so were you but I
01:14:12 would like to invite chief Mike Sellers
01:14:13 to come forward to talk about the
01:14:14 planning committee, chief sellers?
01:14:21 >>Thank you very much, Mayor, Council,
01:14:22 especially for recognizing this very
01:14:23 important program every 15 minutes some
01:14:24 of a lot of the information we provide
01:14:28 is very similar to what the mayor just
01:14:29 provided but the Santa Clara Police
01:14:30 Department in Santa Clara unified
01:14:31 school district hosted a two day drunk
01:14:32 driving and distracted driving
01:14:36 Prevention program at Santa Clara high
01:14:37 school. On May 2 and third. 10th, 11th
01:14:39 and 12th grade students participated in
01:14:41 the every 15 minute program. It's
01:14:46 called every 15 minutes because
01:14:47 nationally every 15 minutesA person
01:14:48 would be killed by a drunk driver.
01:14:51 Fortunately it has gotten a lot better
01:14:53 than that. This two day event created a
01:14:57 realistic understanding of the impact
01:14:58 peopleInvolved in alcohol-related
01:15:00 distracted drivingFatal collisions.
01:15:03 This dramatic program draws on students
01:15:06 emotions to serve as a powerful toolTo
01:15:08 create awareness amongst students and
01:15:11 they are not visible. It also extends
01:15:13 beyond the studentsThat help teens
01:15:17 realize how many people are actually
01:15:18 affectedBy their decisions.On the first
01:15:23 day, members of the police department
01:15:24 when inside the classroomsAnd announced
01:15:25 one by oneThe 20 preselected students
01:15:28 that were killedBy a drunk driver. An
01:15:34 obituary was in red in the classrooms
01:15:36 and arose was placed on the deceased
01:15:38 students desk. These 20 students were
01:15:41 now the living dead. A couple of hours
01:15:46 later, a fatal car collision involving
01:15:47 fourStudents was stagedOn the football
01:15:50 field. The communication public safety
01:15:54 dispatchers and emergency response by
01:15:55 police, Fire, paramedics was realistic.
01:16:00 Students witnessed firsthandAn injured
01:16:04 student that received medical treatment
01:16:05 on the scene.Are critically injured
01:16:09 student was then transported to Valley
01:16:10 Medical Center Hospital, Another student
01:16:15 perform field sobriety test and was
01:16:16 eventually arrested while driving under
01:16:17 the influence orFor causing all this
01:16:21 destruction and unfortunately, the
01:16:22 final student diedFrom the injuries and
01:16:26 was left at the scene in a body bag.
01:16:30 Later that night, all 20 living dead
01:16:31 studentsWere sequesteredFrom their
01:16:32 familyAnd friends overnight. During
01:16:37 that time the students participated in
01:16:38 the driving exerciseSimulating being
01:16:40 drunk, listens special guest speakers
01:16:47 Who is personally experience the
01:16:48 tragedy of losing a loved one to a
01:16:49 drunk driver and they also wrote a
01:16:50 letter to loved ones about whatThey
01:16:52 would've done if their lives had not
01:16:54 been tragically taken shortBecause of a
01:17:00 drunk driver. On the second day, the

01:20:23 it tonight along withThe Norcal first
01:20:27 alarm girls fire can't because it
01:20:28 showing our community how muchWe are
01:20:29 engaged in in our youth. And soI am
01:20:35 glad that you're both here tonight even
01:20:36 though there are two totally different
01:20:37 topics, But at the same time, I felt
01:20:40 that the program needed to be recognized
01:20:42 Just because so much goes into itAnd
01:20:44 they have obviously my family has been
01:20:48 a part of it going back almost 6 or
01:20:49 seven months ago when Kaylee informed
01:20:52 me that she had been asked to be a part
01:20:53 of the programAnd when I wentTo the
01:20:56 first meeting with all the officers and
01:20:58 the teachers and the students and the
01:21:00 parents, I think a lot of you were
01:21:07 involved with the dare program and they
01:21:08 saw me sitting in the room they go why
01:21:09 are you here? And soThis is not there,
01:21:13 This is my daughter participating in
01:21:14 this program.I have to say through a
01:21:16 very democraticProcess of drawing straws
01:21:20 that my daughter was selected to be the
01:21:22 Child.That was going to die in the
01:21:27 scene. So when I found that out,That
01:21:33 was very hard. Needless to say as a
01:21:34 parent, any parent would agree that
01:21:35 that was not something that you were
01:21:36 looking forward to that you would be
01:21:37 looking forward to.But through the
01:21:39 whole process, I am just so proudThat
01:21:45 we have this program and from talking
01:21:46 to friends around the country I am
01:21:50 happy to know that it's program that
01:21:51 just goes beyond the city of Santa Clara
01:21:55 , that there is a lot of schools around
01:21:56 the country that are also promoting
01:21:57 this programBecause it's teaching our
01:21:58 studentsVery importantLife skills and
01:22:03 Why they shouldn'tDrink and drive and
01:22:08 especially as they're going out into
01:22:09 the world, Their graduating tomorrow
01:22:13 and this was just a very timely program
01:22:16 to have, actually it was I think I
01:22:17 really-- The week before the prom. It
01:22:20 was even more timely. It just teaches
01:22:22 so much and I knew that it shouldBe
01:22:27 recognized and I appreciate so much
01:22:28 miss Kudo and Ms. Grossman for all the
01:22:29 timeThat you devote to the program
01:22:32 coordinating all the studentsAnd just
01:22:34 seeing it through. I just don't know
01:22:41 what more I can say except just thank
01:22:42 you so much for all the time and what
01:22:44 you're presented to our students, What
01:22:48 you presented to our children and given
01:22:49 them the opportunity to just go into be
01:22:50 really responsibleAdults. So thank you
01:22:53 for all that you've given back to our
01:22:55 kids. Thank you.

01:23:06 Wilcox high school, been involved with
01:23:07 this when we do it at our high school,

01:23:17 avoid with our students. So I
01:23:18 appreciate the time. It does make an
01:23:24 impact on the students. I know that,

01:27:33 bisexual transgender and queer, LGBTQ,
01:27:39 Pride month. LGBTQ Pride month
01:27:40 celebrates LGBTQ culture and prideAs
01:27:44 well as commemorates the Stonewall
01:27:47 riots that forever changed the course
01:27:50 of modern social movements. The
01:27:52 Stonewall riots in New York City on
01:27:55 June 28, 1969Was a historic turning
01:27:58 point that spark lesbian gay bisexual
01:28:02 and transgender civil rights movement.
01:28:07 LGBTQ Pride marches and celebrations
01:28:08 have been held every year in June
01:28:12 across the United States in recognition
01:28:13 of the Stonewall riots. Yesterday we
01:28:14 held our third annual LGBTQPride flag
01:28:24 raising ceremony and you can see the
01:28:25 flag right outside City Hall here. We
01:28:26 were honored to haveSupervisor Susan
01:28:28 Ellenberg, representative as a speaker
01:28:30 As well is Billy DeFrank board president
01:28:35 Gabrielle and tell her that she was
01:28:36 with us thisEvening, if you are
01:28:37 wondering who is that woman flying that
01:28:42 Flag over there, that's Gabrielle. They
01:28:43 joined us as we raised the rainbow flag
01:28:44 over City Hall. We will fly throughout
01:28:46 the month of June. So at this time I
01:28:48 would like to introduceBilly DeFrank
01:28:50 board president, Gabrielle and tell of
01:28:53 which as Board President. Gabrielle is
01:28:59 committed to political advocacy on
01:29:00 behalf of the community and has
01:29:01 implemented programs that support the
01:29:03 vast and diverse needs of the South Bay
01:29:05 community of LGBTQ people. So thank you

01:29:18 we know it today, We really, really
01:29:21 appreciate city councils like yoursAnd

01:29:32 there when Stonewall happenedExcept I
01:29:34 was in Sydney, Australia, And it was a
01:29:37 global movement. We came out publicly
01:29:40 gay and lost our jobsAnd there's always
01:29:45 a back lash after a good thing happens.
01:29:53 This was worth it because being who we
01:29:54 are is the most important thing. And if
01:29:56 anyone has ever done anySelf-realization
01:30:02 , That is the thing that you have to
01:30:03 discoverIs who you are. And embrace
01:30:05 that. And it's really difficult as an
01:30:09 LGBTQ to embrace itWhen your own family
01:30:12 rejects you. We are the only minority
01:30:14 group that our own family rejectsAnd so
01:30:19 we have to findFamily everywhere. And I
01:30:22 have to say, you are part of our
01:30:25 family, because of how much you have
01:30:27 embraced us.And flying the rainbow
01:30:31 flag, this is the transgender flag, We
01:30:32 haveBeen supporting the transgender
01:30:35 community, especially, because they
01:30:38 have been marginalized, Banned from the
01:30:44 military, all kinds of things and the
01:30:45 threat of being banned from all
01:30:46 healthcareBy the federal administration
01:30:50 . And so we have to fightA big fight
01:30:55 and we will continue to do that, And
01:31:01 thank you so much, and it's not just
01:31:02 city Council, it's alsoLaw enforcement
01:31:03 here, Your chiefAndYour firefighters,

01:33:21 would like to thank our LGBTQ
01:33:22 councilmember, Jamie MacLeod, who
01:33:23 inspired me and gave me hope to pursue
01:33:25 my dreams because she got to do the
01:33:26 same thing. I would like to thank Mayor
01:33:31 Gilmore for raising the pride flag that
01:33:32 led the ceremonies here for the last
01:33:33 three years in a row and I would like
01:33:34 to thankVice Mayor mayhem who joined me
01:33:39 last year during my campaign in the
01:33:40 Silicon Valley pride parade, that was a
01:33:41 real honor. And in the same time I
01:33:43 would like to thank councilmemberWhat
01:33:49 nobby in 2016, you're my opponent, but
01:33:50 you supported my communityAnd solutions
01:33:52 for our LGBTQ brothers and sisters. And
01:33:58 then last year Karen Hardy embrace my
01:33:59 community and listen to me not only as
01:34:00 a gay man but as a man of faith and for
01:34:02 my Christianity. Also, councilmember

01:34:07 nothing but loving and supportive to my
01:34:14 community and we will support each
01:34:15 other through tough times and lastly
01:34:16 councilmember Teresa O'Neill, you've
01:34:17 been a huge supporter of my community,
01:34:23 I have known you for a long time and
01:34:24 your work has gone all the way back
01:34:25 today's foundation, and that's why I've
01:34:26 always been a follower of yours. This
01:34:27 leads me to ask our city Council to
01:34:28 join Mimi and members of the LGBTQ
01:34:30 community in the city of Santa Clara to
01:34:33 be in this year's Silicon Valley pride
01:34:34 parade, to be representation of Santa
01:34:37 Clara because we haven't had that

01:36:48 of innovation around community services

01:36:55 led San Jose's robust capital projects

01:36:59 served as assistant director for comp

01:37:02 Jose, multiple complex projectsDuring
01:37:05 her 11 years in the city manager's

01:37:10 want to say that she has deep roots in
01:37:11 Santa Clara, her family, Many of her

01:37:17 they have also been buried or retired

01:37:22 alumni of Santa Clara University where

01:37:25 science and is an active alumni still.

01:38:10 for purposes ofIt's share to support
01:38:12 the parade. The Council put a challenge
01:38:16 up to haveThe interested partiesRaise
01:38:21 almost $80,000 before consideration of
01:38:24 completing the financial commitmentOn
01:38:27 behalf of Santa Clara. I want to report
01:38:31 This evening that I have the
01:38:32 opportunity to check in with Anna and
01:38:33 they areNear $78,000 and we have had an
01:38:36 opportunityOver the last couple of
01:38:41 weeks to review bank statements and
01:38:42 hear about other fundingOpportunities
01:38:44 that are in the future, so I feel
01:38:45 confidentThat by June 25They will reach
01:38:50 Or exceed the $80,000 level that they
01:38:55 were charged to raise, and I just
01:38:56 wanted to make that update because I
01:38:57 know this was a part of the processThat
01:38:58 if the Council did want to proceedYou
01:39:00 would direct us to prepare the required
01:39:01 documentsTo put the city's funding
01:39:04 portion forward.That's the

01:40:31 team, because they're just like you
01:40:34 said if anyone to do it, they certainly
01:40:35 didAnd we hit the ground running as
01:40:38 soon as you said go for it. And to pull
01:40:42 in this much money is a sign that the
01:40:43 community really wants it, people of
01:40:49 been so generous, they have just, it
01:40:50 was coming at us constantly, and we're
01:40:51 like, yes, yes, yes.And so the
01:40:52 community is very enthused.Mary has
01:40:54 been hitting the streets since
01:40:57 yesterday getting permissions all the
01:40:58 way around the route with her team and
01:41:05 there's literally people jumping up and
01:41:06 down, they're excited about the parade.
01:41:07 So far no objectives, no objections to
01:41:08 the parade. SoWe have been blessed and
01:41:10 we are fortunate that we have this kind
01:41:13 of leadership in Santa Clara that's
01:41:14 open-mindedTwo ways to bring the
01:41:18 community together and keep them
01:41:19 together. So I am on a high note right
01:41:24 now. Any questions for me?

01:41:26 on you to come back in the state with
01:41:28 some progress, And I think the money
01:41:33 Didn't just come to you, you all work
01:41:35 really, really, really hard, So I can

01:41:43 ago? But you can recharge now, and it's
01:41:45 coming back.I've just seen the amount

01:42:06 core group, you really, you have really
01:42:09 reached out far and wide. SoI'm going
01:42:13 to recommend the Council that we do our
01:42:14 part from the cityTo support that and
01:42:19 Allocate the money for June. So I don't

01:42:30 a parade to plan.

01:53:13 study session for the budget, so I will
01:53:14 briefly go over the budget calendar,
01:53:16 Touch on your council strategic pillars
01:53:18 , Discuss the key initiatives, Go over
01:53:22 a little bit of the new look on the
01:53:23 budget, budget overviewAnd there were
01:53:25 some changes to the proposed budgetAnd
01:53:28 now there will be another change we do
01:53:29 the adoptionBased on the parade funding.
01:53:33 So we will talk about that on the
01:53:35 25th. And then when we first didThe
01:53:40 study session, we did not have the
01:53:41 convention center budgetAnd we now have
01:53:42 that, and we also haveSpecter
01:53:46 representatives here for if you have
01:53:47 any questions. So on the budget
01:53:50 calendar, April 30, we releasedThe
01:53:52 proposed biannualOperating budget,
01:53:57 believe this is probably the earliest
01:53:58 we were able since I've been hereTo get
01:53:59 the budget out. May 7 we had our first
01:54:07 City Council study session on the
01:54:08 operating budget, capital improvement
01:54:09 program changes and we discussedThe
01:54:10 city Council priority matrix. On my
01:54:16 17th, we ask for any final
01:54:17 reconciliation of the Council priority
01:54:18 matrix be transmitted to the city
01:54:21 manager's office. May 21, we held a
01:54:25 study session on the revenue strategies
01:54:26 with the user fee studyAnd tonight we
01:54:28 are doing the second city Council study
01:54:30 session where we will review and
01:54:33 approve the convention center budget
01:54:35 and then also included within your
01:54:36 packetAre the responses from any
01:54:39 questions that were asked at the May 7
01:54:41 study session. June 25, We will be
01:54:52 coming before you for the adoption of
01:54:53 the biannual operating budget also, the
01:54:54 limit will be included, and he CIP
01:54:55 changes and also the list of CIP
01:54:56 carryovers. Also on that date, we will
01:54:58 be adopting the phase oneOf the
01:55:00 municipal phase study.So just wanted to
01:55:06 , I know we have talked about the
01:55:07 Council strategic pillars a lot. I do
01:55:09 want to say thatIf you look at the
01:55:12 icons you will notice in the new budget
01:55:14 Format that when we do a service level
01:55:16 changeOr a budget proposal, you will
01:55:21 see one of these icons next to that,
01:55:22 and that's when itWalls within that
01:55:23 pillar. So if we are doing the
01:55:25 sustainability programYou will see that
01:55:27 icon in those departments. So just
01:55:32 wanted to kind of call that out,
01:55:33 something we are proud ofBeing able to
01:55:34 do this year.The key initiatives, we
01:55:43 continue to work to eliminate the
01:55:44 deficits in the general fund with
01:55:45 revenue opportunities and expenditure
01:55:46 controls, I think you probably are aware
01:55:48 that our 10 year forecast keeps
01:55:49 looking better and better as we are
01:55:52 able to fine-tune our revenues and
01:55:53 really look at our expenses. We have
01:55:58 addressed city Council priorities
01:55:59 within our limited resources. This
01:56:02 budget includes a lot of resource
01:56:03 serviceApproaches and I will talk about
01:56:06 one later in this presentation. We were
01:56:07 able toInclude the real estate program,
01:56:11 citywide sustainability program, we are
01:56:14 constantly improving your Stadium
01:56:15 oversight, we are increasing strategic
01:56:19 communications and we were also able to
01:56:21 Use what we call turnaround funds for
01:56:23 turnaround initiatives of up to $2
01:56:25 million to upDate outdated policies and
01:56:29 procedures. So the new lookAs I said,
01:56:35 this budget is completely different
01:56:36 from the past budgets, this is
01:56:38 transition from a transactional budget
01:56:45 By which was organized by fun, now is
01:56:46 organized by department, and I put an
01:56:47 example up here so public works is one
01:56:48 of them where it was in several
01:56:49 different funds, You would see the
01:56:52 general fund streets and highways and
01:56:54 solid waste now it's allYou will see
01:57:01 all those funding sources within that
01:57:02 one department. Revenues are now reflect
01:57:03 did as sources and expenses are uses.
01:57:08 When you hear assay sources and uses
01:57:09 statements, that's what we're talking
01:57:10 about,Revenue and expenses. I mentioned
01:57:11 the service level changes, how we align
01:57:16 them with the city Council strategic
01:57:17 pillars and how that's reflected in the
01:57:18 budget. This budget also includes
01:57:21 budget and fiscal policies, this is
01:57:22 something we have never had, We will be
01:57:29 trying to fine tune this also, so as
01:57:30 you see future budgets you will see
01:57:31 more and more these policies actually
01:57:32 in print so that we have them. We
01:57:36 incorporate two new internal service
01:57:37 funds, one for information tech algae,
01:57:38 our IT, and public works. And we have
01:57:43 comprehensive budget financial
01:57:44 statements, and that is the beginning
01:57:45 and ending fund balances. In the past
01:57:51 you may have notice you couldn't tell
01:57:52 how much money was actually in those
01:57:53 funds, you didn't have a beginningAnd
01:57:55 you didn't have an ending, you just had
01:57:56 the middle. So now we are showing you
01:57:57 how much money is actuallyAnd all the
01:57:58 funds.So the for the proposed fiscal
01:58:00 year 19 Mac-20 Mac and '20-'21 budget,
01:58:09 this is the first year for the
01:58:10 operating to be a two-year budget. Last
01:58:11 year we incorporated the CIP. The
01:58:12 budget is balanced, fiscally
01:58:13 responsible andRespecter's were noted
01:58:15 during our outlook we did the tenure
01:58:17 forecast. The tenure financial forecast
01:58:20 continues to provide a roadmap for
01:58:24 managing forward in a fiscally
01:58:25 responsible manner. Continue to build
01:58:27 up our reserves and for strategic use or
01:58:33 They are at very high levels, which is
01:58:34 good. We are continuing to invest in
01:58:36 city CouncilPolicy priorities and it
01:58:40 administration needs to advance in
01:58:41 service our gap risk areas, and then
01:58:43 again, this isSignificantly more
01:58:45 transparent budget.So we did have some
01:58:53 changes to our numbers change from the
01:58:54 previous study session, but we are still
01:58:59 A $1 billion entity. I want to point
01:59:00 out the second year 2021 if you look at
01:59:01 the stadium Authority, that'sThe
01:59:02 stadium Authority is on a one-year
01:59:03 budget, so we just did an estimate
01:59:05 there to kind of give you a visual of
01:59:06 theCost. So $1 billion enterprise
01:59:11 company, I spoke about the reserves, so
01:59:18 in 1920, we are anticipatingA $70.5
01:59:21 million in the general fund
01:59:23 Stabilization reserve andIn 20 Mac-'21,
01:59:35 we are anticipating drawing some of
01:59:36 those down for the turnaround
01:59:37 initiatives I spoke about earlier so we
01:59:38 are anticipating $69.3 million. We also
01:59:39 have other reserve fundsAnd these may
01:59:40 change depending on where we end upAt
01:59:41 the end of this fiscal year,Whether we
01:59:43 feel some of these buckets.So just to
01:59:47 quickly go overThe budget numbers, you
01:59:52 can see in '19-'20, we haveFor the city
01:59:55 $844.5 million budgetedAnd in 2021Just
02:00:00 a slight increase of 1.9 to $246.4
02:00:03 million.And I just want to point out to
02:00:09 you, you see the column or the line
02:00:10 this is net adjustments, this is taking
02:00:11 outAny interfund transfers or internal
02:00:14 service fund charges so we are not
02:00:15 double counting.I would like to point
02:00:19 out on the graph howOur fundsAre
02:00:28 Budgeted and you can see the largest
02:00:29 being our enterprise fund which
02:00:30 includes our electric, our water,
02:00:31 Cemetery, that, it makes up 64.9% or
02:00:35 $652.1 millionOf our total budget and
02:00:38 the general fund makes up a smaller
02:00:41 portion at $26.2 million, 26.2% at 262.7
02:00:47 at $262.7 million.And you can see a
02:00:50 fairlySame reflection here in the 20
02:00:55 -'21 budget.A summary of our full-time
02:01:00 equivalent positions, we in '18-'19
02:01:02 Budget, we had 1100, we had 1111.25
02:01:09 FTEs, and then we added six during this
02:01:10 fiscal year.So those were not included
02:01:20 In the actual adoption. So we have a
02:01:21 change versus 20.5, six of those were
02:01:22 already approved in this fiscal year.
02:01:23 And then we have one additional
02:01:26 Projected for 2021, which is the city
02:01:27 attorney office.And here, this is just
02:01:34 for, I won't go over, you can just see
02:01:35 where the increases and decreases are in
02:01:36 By department.So we did receive some
02:01:40 changes as requested by May 17, The
02:01:45 Council submitted these to the city
02:01:46 manager, andThe first one isWas
02:01:53 submitted by Mayor Gilmore and
02:01:54 councilmember O'Neill, asking to
02:01:55 instead of addingA web and digital
02:01:57 managerInstead of making a management
02:02:03 analyst and add $50,000 for ongoing
02:02:04 supplies, staff as an alternate
02:02:06 proposal, we think that we canDo one of
02:02:10 the shared resources that we spoke
02:02:11 about earlier and actually be able to
02:02:12 do both, do a lot of the written online
02:02:15 communication to promoteThe love Santa
02:02:19 Clara program while still having
02:02:20 communication bandwidth, Which will
02:02:22 increase community engagement. This is
02:02:25 also in your packet, In your report to
02:02:28 Council. SoTelling you exactly what we
02:02:34 would do with this position. And also
02:02:35 the $50,000 has been included in our
02:02:36 numbers.Our alternate recommendation is
02:02:43 that we maintain the web and digital
02:02:44 media manager, we know that'sA somewhat
02:02:48 misleading title but the job
02:02:49 specification is more akin to
02:02:50 communications professional services
02:02:51 that we seekAnd clearly surfaced as a
02:02:52 need. We will go through the civil
02:02:56 service process and retitle that
02:02:57 position and fine-tune it based on some
02:02:59 recent conversation with the committee
02:03:03 as well is hearing from the Council
02:03:04 about some of the unique needsThat we
02:03:05 have for additional communication
02:03:09 services as well as we think with the
02:03:10 positionOf this level we can absorb the
02:03:12 loveSanta Clara initiative with the
02:03:19 $50,000 of materials and supplies, so I
02:03:20 think that's a betterSolution with
02:03:22 respect to our civil-service clop job
02:03:26 -- job classifications in the exact
02:03:27 specifications and expertiseThat the
02:03:29 council sees.Then I also want to point
02:03:34 out we still have the $200,000 that we
02:03:35 allocated, I believe it's two years ago
02:03:38 for the communication plan, that is
02:03:39 still in the budgetOngoing for both
02:03:40 years.We also receivedA suggestion from
02:03:48 councilmember Watanabe, and that was to
02:03:53 Find a human resources department
02:03:54 internship program. This program would
02:03:57 provide an opportunity for high school
02:03:58 students that need a supportive summer
02:03:59 job, Would provide direction and
02:04:07 experience for future jobs including
02:04:08 careers in public service. We have
02:04:09 included $100,000 from the general fund
02:04:10 budget stabilization reserve for this.
02:04:12 There were also some additionalChanges
02:04:14 that came to light afterThe study
02:04:20 session, we wanted to reallocate sister
02:04:21 cities fundings from parks and rec to
02:04:22 non-departmental to increase
02:04:26 transparency, it's a small amount,
02:04:27 almost $6000. There's also an increase
02:04:29 for the police department budget to
02:04:30 reflectThe recent agreement approved
02:04:34 for the police officers Association,
02:04:35 there were elements that we can
02:04:37 actually absorb, but we do need to make
02:04:40 a couple of changes for theThe but and
02:04:45 I believe it's different comp. And then
02:04:48 also the increase in convention center
02:04:49 budget, By $100,000 for city related
02:04:53 contingency items.So I just want to
02:04:58 quickly go over what the convention
02:04:59 centerSubmitted and then again, if you
02:05:02 have specific questions,
02:05:08 Representatives are here to answer any
02:05:09 questions. So this is the prefrontal A
02:05:13 pro forma that was submitted to us
02:05:14 during the proposal from Specter. You
02:05:15 can see total revenue was $18.5 million
02:05:17 , Total expenses at$16.2 million, and
02:05:23 they were anticipating a net income of
02:05:24 $2.3 million. They have had some time
02:05:25 to get settled and see thatThey need
02:05:31 some additional items, so they are
02:05:32 asking for $350,000 in adjustments.
02:05:37 Then net income is staying the same but
02:05:38 they're asking for 130,000Dollars for
02:05:45 personnel expenses for full-time sales
02:05:46 manager position, so maintenance
02:05:47 expense of $85,000 for preventative
02:05:50 maintenance and repair, $70,000 for
02:05:51 additional tradeshow and travel and
02:05:53 marketing of $65,000.So this will
02:05:55 reduce the net incomeTo $1.9 million,
02:05:59 and here is theJust walk through of
02:06:02 what that looks like.On the capital
02:06:09 needs, you can see that the total over
02:06:11 the five years that was submitted was
02:06:13 $18.7 million. The first year in 1920,
02:06:19 the CIP need is six point$5 million.
02:06:23 What we have available for that CIP is
02:06:25 $4.2 million with Spectra's investment
02:06:28 being $1.2 million and the city of
02:06:30 Santa Clara budget includes $3 million
02:06:34 for CIP improvements. Those improvements
02:06:35 include carpet, doors, paint, roof,
02:06:38 Repair marquees and repair and upgrade
02:06:42 of the HVAC system and security the's.
02:06:49 So that concludes my presentation, I am
02:06:50 happy to answer any questions, have all

02:07:41 proposed 10 projects to our contract
02:07:42 administrator that we believe we can at
02:07:44 least get started within the first

02:07:48 the bid process and how long those
02:07:49 things take to have those come in, the
02:07:50 processWill begin within the first year
02:07:54 of these 10 projects which include
02:07:56 Fixing some leaks in the roof, getting
02:08:01 some new carpet, getting some new paint
02:08:02 in there, doing some upgrades to the
02:08:03 market needs and those things. We've
02:08:05 identified what we think are things
02:08:06 that are both aesthetic and also
02:08:07 operational.

02:08:44 there is a difference. If I'm looking at
02:08:48 Percentage of general fund for salaries
02:08:49 and benefits,Hours and 78.5% whereas
02:08:53 Sunnyvale is around 59And Palo Alto is
02:08:57 around 58. So there's a differential of
02:08:58 around 20%Delta on that. So if we can
02:09:02 look at that Delta like whyThat's a
02:09:06 huge Delta of 20%, what Palo Alto are
02:09:09 doing great that they are saving that
02:09:10 20% of their budgetInto the benefits
02:09:13 and salary, and same thing is about
02:09:15 expenses also. There we have a delta of
02:09:21 around 15% on one side, like if we have
02:09:22 68%Of our expenses, 67
02:09:25 : 69% of our expensesTotal ratio on
02:09:28 salaries and benefit, Whereas Sunnyvale
02:09:31 has 52.8And Palo Alto has 59. So that's
02:09:35 a big else on that so we can do some
02:09:39 study how we can improve those things
02:09:40 and make more funds available for the
02:09:44 general fund for the committee, that
02:09:45 would be great.

02:12:20 the funding is needed to develop an arts
02:12:21 and culture master plan, The master
02:12:26 plan will enhance credibility when
02:12:27 asking for additional fundingFrom the
02:12:28 county, the state, or the national
02:12:30 endowment for the art. I think we have
02:12:34 an opportunity here to make a huge leap
02:12:36 in the way that the city both values and
02:12:39 funds public artAnd cultural diversity
02:12:43 eventsAs well as commemorative events.
02:12:47 So now is the time. I know that this
02:12:52 has been brought for several years
02:12:53 before the Council, and by several
02:12:54 peopleMention this fee earlier this
02:12:59 evening. My request is just to
02:13:04 understand the status of where this
02:13:05 development fee or 1% for the artsDan's
02:13:08 and when we can hope to see some
02:13:09 movement on that.

02:13:36 to direct us. We have folded it into

02:13:45 actually hired EPS and they are
02:13:46 studying it right now. They are
02:13:50 compiling the rest of the information,

02:13:56 couple of questions outstanding, but we
02:13:57 are looking at the art impact fee and
02:14:01 then any other fire impact fee, police
02:14:02 impact fee, so we will be scheduling a
02:14:03 study sessionFor them to present it to
02:14:05 the Council and then we will come back
02:14:06 for adoption.

02:15:10 Los Altos a couple of days ago and saw
02:15:11 that they had very attractive and
02:15:12 artisticPublic bike racks. For some
02:15:17 time I've been advocating for public
02:15:18 arts fee for developments. Many cities
02:15:19 aroundUs impose a 1% fee from
02:15:21 developers. NeighborsThat have these
02:15:25 fees include San Francisco, Oakland,
02:15:27 Los Altos, Berkeley, Redwood City. When
02:15:31 I first asked about this? I was told
02:15:32 that the city of Oakland was being sued
02:15:33 by the building Association for itBeing
02:15:36 considered a taking. That lawsuitWas
02:15:39 settled in favor of the public art fee
02:15:40 in OaklandIn February 2018.In JulyOf
02:15:48 that year, the city of Los Altos
02:15:49 adopted a 1% fee for developments for
02:15:50 more than 10 units.If we had applied a
02:15:52 1% public arts be on the related project
02:15:55 , we would've had $70 million to spend
02:15:57 on public artIn the city. We have a lot
02:16:00 of very large developmentProjects being
02:16:02 proposed in Santa Clara. Let's get some
02:16:06 art in our new downtown.We should be a
02:16:11 city where the only art in Santa Clara
02:16:12 is on our utility boxes.Public art
02:16:14 should be another reason to love Santa
02:16:16 Clara. Regarding the convention center,
02:16:22 I agree that the convention center has
02:16:23 been sorely mismanaged in the past and
02:16:25 money was not being set aside for
02:16:26 repairs and upgrades. In the past I've
02:16:28 complained regardingAppropriation
02:16:31 request that come to the CouncilFor
02:16:34 painting and electrical affairs as
02:16:35 neededAnd that money is from the
02:16:37 general fund. So my question isAre the
02:16:40 books now completely independentSo that
02:16:43 we don't keep just getting more requests

02:21:01 to workCollegiately and cooperatively
02:21:11 with our neighbors in San Jose and I
02:21:12 was specifically approached by
02:21:13 councilmember vice Mayor chappy Jones
02:21:14 and Deb Davis is also involved because
02:21:21 We had vice Mayor Jones and I both
02:21:22 serve on the BTA board, and we have met
02:21:23 and been talking aboutA variety of
02:21:28 things that we could do to improve the
02:21:29 transportation particularly along the
02:21:38 areas of our border where we have had
02:21:39 some areas of contention in the past.
02:21:40 You may be aware that there is a
02:21:41 project that'sGoing to be underway
02:21:45 under the auspices of ETA that San Jose
02:21:48 , Santa Clara and Cupertino have gone
02:21:49 togetherTo request a study, VTA has
02:21:58 obtained funds to look at what else
02:21:59 might we do with helping to move old
02:22:10 thousands and thousands of people to go
02:22:11 up and down Stevens Creek Ola Bard and
02:22:12 as Valleyfair continues to expand, as
02:22:13 Santana Row expands, as potentially
02:22:16 Santa Clara's portion of Valleyfair or
02:22:17 some of our properties, Sivan's Creek
02:22:28 in Santa Clara as they perhaps
02:22:29 redeveloped, what might we do there?
02:22:30 This is, I think it's interesting that
02:22:31 we had Director Tavarez here from
02:22:35 Caltrans tonight, you talked about
02:22:36 looking in trying to find some
02:22:37 innovative ways and talked about some
02:22:38 of the areas where some of the new
02:22:40 transportation technologies are being
02:22:41 tested. So the thought that in the
02:22:59 discussions that I've had with vice
02:23:00 Mayor Jones is that, and they proposed
02:23:01 an area, when you look at, it would
02:23:02 kind of general, this innovation zone
02:23:03 would be the area approximately from
02:23:04 Interstate 280 on the south to northTo
02:23:16 prune ridge, over to Saratoga Avenue
02:23:17 and then the 880 and it would be an
02:23:18 area where we would work together and
02:23:19 there would have to be a little bit of
02:23:20 staff time to set some parameters to
02:23:21 create an area where a lot of the
02:23:23 innovative companies that are in our
02:23:24 area, particularly those that are
02:23:25 looking at transportation, where they
02:23:26 could do some piloting and testing in
02:23:34 an area where there's a lot of people
02:23:35 around, because it's all well and good,
02:23:36 obviously you have to build up to how,
02:23:37 you don't do your first test of anything
02:23:39 Like in the middle of Highway 101 at
02:23:42 rush hour or something, but to have the
02:23:43 opportunity toLook at doing something
02:23:49 With some different modes of
02:23:50 transportationIn an areaThat's going to
02:23:56 be an increasingly important part of
02:23:57 Santa Clara, Cupertino and San Jose,
02:24:03 this test zone area specifically in San
02:24:04 Jose and Santa Clara, and I wanted to
02:24:06 comment, I saw an email that came in
02:24:07 from a residentToday thatTied this
02:24:09 projectTo potential change ofBike lanes
02:24:14 or whatever,I mean, at this point, the
02:24:20 two, those two projects are separate,
02:24:21 that isn't atThis point contemplated.
02:24:24 We wanted to be able to be open because
02:24:25 there are interests being expressed by
02:24:28 various,Really, Silicon Valley is
02:24:33 becoming the center of the automotive
02:24:34 and transportation industryThat almost
02:24:36 every major companyFrom around the
02:24:39 world that's involved in transportation
02:24:42 of one sort or another now has a
02:24:43 presenceIn Silicon Valley. And so the
02:24:45 thought is that there has been interest
02:24:52 expressed from some of those companies,
02:24:53 it's all at kind of the informal stage
02:24:54 At this point to do some various
02:24:56 creative thingsAnd so the thought was
02:24:59 to provide them an areaWhere they could
02:25:02 do some live testing.And soThe further
02:25:08 thought on that was that we would,
02:25:14 Maybe we should have some, rather than
02:25:15 having people going out kind of doing
02:25:16 things on their own, which has happened
02:25:17 in some cities where things have just
02:25:19 started and kind of like analogous to
02:25:21 How we've had some issues with the
02:25:22 scootersWhere people just started
02:25:28 Bringing in scooters and leaving them
02:25:29 all over the place or doing things
02:25:30 without having someGuidelines, soThis
02:25:34 request is toDirect the city managerTo
02:25:45 allocate and I think at this point it
02:25:46 would be relatively small,Some
02:25:49 assistance from staff and public works
02:25:51 That would work and work with San Jose
02:25:53 Department of TransportationVice Mayor
02:25:55 Jones, myselfIn a couple of others to
02:25:59 look at how we couldSet up an area to
02:26:03 do testing for transportation.

02:28:10 this innovation zone, They mention her
02:28:14 name because of our location, But it's
02:28:17 all San Jose driven.

02:29:51 concern is the waiver of fees, what
02:29:52 they've been doing and what they

02:30:07 question, it looked to me like this was
02:30:08 kind of a blank check. I kind of made a

02:32:56 about it, but it is a good starting
02:32:58 point where we can collaborate and we
02:33:03 can find out some solutions down the
02:33:04 line. If we don't likeWe always have a
02:33:05 right not to participate, we withdraw
02:33:08 from it, but if somethingWhich can
02:33:11 improve the quality of life and give us
02:33:13 some good ideas to use the technology
02:33:16 that small, we can extrapolate to a
02:33:20 bigger city down the line. I support
02:33:21 thatLike it's a good thing, and we are
02:33:25 really lacking in implementingThe
02:33:27 technologicalTo improve the quality of
02:33:33 life. And this can be a small step,
02:33:34 maybe reach out we can do pretty good
02:33:35 as mentioned by (inaudible) we should
02:33:38 not miss on this opportunity, We should
02:33:41 look and really seriously and
02:33:43 especially that we have not asking for
02:33:45 much of the resources. Down the line,
02:33:48 we may be once we have a concrete
02:33:52 roadmap of what we really want to do.
02:33:53 It is sort of gathering of ideasAnd it
02:33:57 can be a good solution from
02:33:58 participation fromDifferent
02:34:03 Public-private participation.And so
02:34:07 many of these companies are ready to
02:34:08 help, like I was at recently at Hitachi
02:34:12 opening ceremony, and they're doing so
02:34:13 muchInnovative things for improving
02:34:16 quality of life of the community.Like
02:34:20 using Blockchain, this is making models
02:34:22 Within the city. SoI am veryPositively
02:34:27 for it, and looking forward, andWe can
02:34:33 bring it together, make it more concrete
02:34:35 , But during an idea this idea for
02:34:38 testing, I am all for it. Thank you.

02:35:10 need to draw from our staff that aren't

02:35:17 staff, our personal staff, they have a
02:35:18 lot ofOther responsibilities, And I am
02:35:21 concerned aboutThe draw that it would
02:35:23 have upon the staff, and we already
02:35:27 know that everybody is overtaxed and
02:35:28 overworked and so there is concernFor
02:35:31 that reason. But also, I mean, looking
02:35:35 atThe innovationsZone, I would like to
02:35:41 evaluate the neighborhood impactAnd also
02:35:48 Look at San Jose's current
02:35:49 transportation projects and they're
02:35:50 spendingAnd also I really feel like our
02:35:55 staff does need some timeTo reviewThis
02:35:59 proposal and what could possibly be
02:36:02 Involved.But alsoWhat concerns me is
02:36:11 San Jose wanting us to participate in
02:36:12 something that we don't know what's
02:36:15 going to be involved, we don't know how
02:36:16 muchWill be involved, we recently
02:36:20 entered into the airport Roundtable,
02:36:26 And the cities in the area are
02:36:27 participating in that with the
02:36:28 exception of San Jose.And that airport
02:36:30 has a big impact on our city, and so
02:36:32 there is no, Right now there is no
02:36:35 accountability at that RoundtableFrom
02:36:39 San Jose as to the impact on our city,
02:36:40 soThings like that give me concern. But
02:36:45 I definitely feel like we need to go
02:36:46 back and review thisAnd have our staff

02:39:46 cities in Silicon Valley, Santa Clara,
02:39:49 San Jose, Cupertino.I think it's a good

02:41:00 Council.Mike Lewis, assistant director
02:41:02 of public works and for this item we
02:41:06 are going to, I will present on the
02:41:07 statusOf our city efforts to create a
02:41:09 bike share program, Staff is looking
02:41:15 for initial Council feedback on what
02:41:16 areas we should include as far as
02:41:17 regulations. Our goal is to have a
02:41:24 viable program that allows our
02:41:25 residents and workforce to take
02:41:26 advantage of this new and exciting
02:41:27 transportation mobility optionWhile
02:41:28 addressing concerns we've heard from
02:41:29 the community in addition to common
02:41:30 issues that are faced by municipalities.
02:41:32 So with that,We do have a presentation
02:41:36 To go through today, we'll try to get
02:41:38 this to work here.So here's a quick
02:41:49 overview of the presentation, it's
02:41:50 about 30 slides, I'm going to try to go
02:41:51 quickly through this, we will go
02:41:52 through some quickBackground in terms
02:41:54 of what the council has discussed
02:41:55 relative to this program. And I will
02:41:56 discuss research and data gatheringThat
02:41:59 our staff have been conducting recently
02:42:01 . We will talk about theAmount of
02:42:04 outreach and meetings we've hadWith
02:42:10 stakeholders, quite a few stakeholders
02:42:11 involved. This will then lead us to
02:42:12 draft regulation topics, We would like
02:42:13 the Council feedback today. One thing
02:42:16 to note is that these draft regulation
02:42:17 topics are included as attachment one
02:42:19 in the report to Council.But with those
02:42:26 topics we do have 12 areas that we will
02:42:27 get into more detail and then finally
02:42:28 we will wrap up with next steps
02:42:29 Questions and comments.So with this
02:42:30 , this is really just to highlight some
02:42:37 of the background for the Council and
02:42:38 some of the members of the public,
02:42:40 roughly around the December, late
02:42:41 December and January time period, the
02:42:43 CouncilPassed a moratorium, emergency
02:42:47 and regular ordinance toHave it like
02:42:49 and scooters here, and this would allow
02:42:52 Staff to return with the citywide
02:42:57 organist and regulations for all
02:42:58 operators. The decision was made to
02:42:59 bring back something quicklySo staff
02:43:01 have been frantically working to gather
02:43:04 information and present it to the
02:43:10 Council. However, just to reemphasize
02:43:11 in January estimated it would take
02:43:12 roughly 6 to 8 month to complete. So
02:43:16 this is a quick overview of our work
02:43:17 plan, research and coordination,
02:43:20 Meetings, quite a few meetings,We did
02:43:24 bring this to our be back already, we
02:43:25 will bring it back to them as well, of
02:43:27 course this council discussion.So with
02:43:30 this slide, it's a quickPrimer on
02:43:32 existing state law and other assembly
02:43:34 bills that are working its way through
02:43:38 Sacramento that apply the scooters,
02:43:40 There are I'm sure more to be had with
02:43:42 this burgeoning technology but was
02:43:45 important for the Council, for the
02:43:48 Committee today are there some things
02:43:49 that limit us, So currently with a be
02:43:53 2989 passingBeing signed by the
02:43:58 governor in September of last year,
02:43:59 effective January of this year, you're
02:44:02 only required when operating one of
02:44:03 these devices, You're only required to
02:44:08 have a helmet if you're under 18 years
02:44:09 of age, you have to have a drivers
02:44:10 license, a permit, the next one, speed
02:44:11 of theseDevices is capped at 15 miles
02:44:16 an hour. When you're kind of getting
02:44:17 into the court transportationItems here
02:44:19 , these devicesAre allowed on 25 mile
02:44:22 in our streetsUnless the street has a
02:44:26 class II or class IVBike lane. So there
02:44:29 are several streets within our city
02:44:33 that they should not be writing on and
02:44:34 last but not least sidewalk writing and
02:44:35 PatParking is prohibited, especiallyIf
02:44:37 this is going to prohibit adequate
02:44:39 pedestrian pathways. There is another
02:44:42 assembly Bill working its way through
02:44:47 Sacramento, this is trickier because
02:44:49 What it does is it will put the same
02:44:52 restrictions on personal devices as on
02:44:54 shared devices connected by local
02:44:57 authority. We are tracking these as
02:45:00 they evolve and we will adjust
02:45:01 accordingly.So these are the various
02:45:07 cities that we decided to look at.
02:45:08 There are quite a few cities with lots
02:45:09 of literature that's all over the nation
02:45:10 , We decided to focus on the Bay Area,
02:45:12 We did dabble a little bit in looking
02:45:15 at Santa Monica in San Diego, those
02:45:16 have beenIn the news a lot lately, San
02:45:20 Diego just past some rules cause we
02:45:21 thought it was worthyTo look at those
02:45:23 and see what those cities were up to.
02:45:27 This is a quick slide to kind of show
02:45:28 youThe cities I mentionedAnd what those
02:45:37 cities have chosen in terms of pilots
02:45:38 versus permanent programs, whether
02:45:39 they're all interested in bike share,
02:45:41 Scooter chair, it's kind of all of the
02:45:42 board, a lot of cities are doing pilots
02:45:44 As they feel like that's good for them,
02:45:45 this Council gave us the direction to
02:45:46 go with the permit program which we've
02:45:48 been working on since.Okay, so with
02:45:54 research with the other cities, a lot
02:45:55 of common thingsCome into play, they're
02:45:58 basically five common issues and
02:45:59 concerns, Speeding is one, writing or
02:46:06 obstructing sidewalks, pedestrian
02:46:07 conflicts, ADA conflicts, obviously
02:46:09 sidewalks, parks trails,Proper parking,
02:46:14 tripping hazards, we've heard from the
02:46:15 VTA that their concern regarding
02:46:16 Interfering with transit stopsAnd then
02:46:19 last but not least is accidents.SoEvery
02:46:28 morning I am waiting for the next
02:46:29 article to show up regarding this
02:46:30 because it is pretty common at this
02:46:31 point.And then this kind of led us to
02:46:35 look at some the typical topics that
02:46:36 cities are looking at. Won't go through
02:46:37 all these, but you roughly have 10 here
02:46:42 it goes from looking at the devices
02:46:43 themselves, parking, fleet management,
02:46:44 maintenance, education, permit fees and
02:46:47 insurance, last but not least, customer
02:46:48 service. So I will reach in meetings,
02:46:54 this was a key for us because what we
02:46:55 felt wasWith the permanent program we
02:46:58 do want to have significant outreach,
02:47:02 so since we got direction in late
02:47:03 January we set up a work plan and
02:47:05 pretty much every week we would try and
02:47:06 meet with folksSo we met two or three
02:47:11 times of city departments, two rounds
02:47:12 community meetings, to meetings with
02:47:17 operators, property owners, Irvine, we
02:47:18 met with them, Summerhill, We did get
02:47:20 the chance to talk to some of the other
02:47:22 cities such as San Jose and Sunnyvale,
02:47:25 Cupertino Chamber of Commerce and the
02:47:26 list goes on.And then as far as the
02:47:28 feedback, right, soThese are kind of
02:47:32 the eight categories thatFeedback was
02:47:43 centered around, parking, speed,
02:47:44 safety, regulation was a big topic in
02:47:45 terms of how much the city wants to
02:47:46 regulate these devices. I think there
02:47:47 is a sweet spot in terms ofTrying to
02:47:48 promoteThe innovative technology versus
02:47:52 stifling it, so as we get into more of
02:47:57 the regulations, we will show you how
02:47:58 you we are trying to achieve that. Data
02:47:59 was a big item, Coordination
02:48:00 enforcement and liability. A couple of
02:48:06 other notes as operators, we met with
02:48:07 them, they did have concerns regarding
02:48:08 caps,Fees and insurance no regulation.
02:48:12 They wanted to do a little more
02:48:14 designated parking after deploymentBut
02:48:18 Summerhill, Irvine, the 49ers, great
02:48:19 America, The mission college and those
02:48:21 folks in the University were very
02:48:28 interested in these programs. It was
02:48:29 great that we met with them because we
02:48:30 got to see them face-to-face and hear
02:48:31 their concerns.So I'm going to jump to
02:48:36 the draft regulation topics. This is
02:48:37 the meat of the discussion today.We
02:48:41 will have roughly 12 areas here and I
02:48:42 will go through these quickly here to
02:48:43 Kind of walk us through whatThe Council
02:48:47 , the one thing I wanted to mention is
02:48:48 that as we are starting to formulate
02:48:54 the ordinance at how we want to run the
02:48:55 program, we do want to try to model it
02:48:56 after what's other cities have been
02:48:57 doing, So we're potentially looking at
02:48:59 creating administrative regulations
02:49:01 that are initially approved by the
02:49:02 Council, Modifications potentially
02:49:06 delegated to the city manager, I think
02:49:07 as we move forward through the rest of
02:49:08 the schedule, We will be able to at
02:49:11 Discuss that further, but it was clear
02:49:14 that being able to set up a program and
02:49:15 being able to adjustedBased on the
02:49:17 needs of the city and what we see in
02:49:18 terms ofReally being out there and then
02:49:22 also the operators as well.So then also
02:49:28 wanted to mention that included in our
02:49:29 staff reportIs that attachment A that
02:49:32 has a good amount of detailOf each of
02:49:35 the areas that we are looking at, some
02:49:38 the key items we believe should be in
02:49:46 included. I'll go over those later.
02:49:47 Some options that we were discussing
02:49:48 but were not included at this time. The
02:49:49 options for these programs run the gamut
02:49:50 and we wanted toReally kind of
02:49:52 centering on certain items in order to
02:49:53 not over regulate it at the same time
02:49:54 try to address concerns.So the first
02:49:58 item here's a shared device
02:49:59 requirements. So the one item I wanted
02:50:02 to focus on here besides making sure
02:50:05 That the business nameAnd the customer
02:50:10 service information is prominently
02:50:11 shown on the device itself is that we
02:50:13 are looking at geo-fencing
02:50:14 capabilities. So this is a techAlgae
02:50:18 that if accurate and successful reflect
02:50:19 how devices operated in pre-'s
02:50:26 designated areas based on GPS
02:50:27 technology installed within the device.
02:50:28 A lot of cities are looking at this and
02:50:29 this is helping regulate areas whereThe
02:50:32 device can operate but also helping to
02:50:33 adjust speed if speed is a concern.
02:50:36 Is parking, this is very hot topic, Big
02:50:38 discussion item,Although there state
02:50:47 law that governs a lot of this, we feel
02:50:48 it's important have local regulations
02:50:49 that provide some clarity and
02:50:50 specifics. And in some areas of focus
02:50:51 on our devices ensuring that they are
02:50:52 parked up right, (inaudible) public
02:50:56 facilities, I mentioned quite a few's
02:50:57 bullet three, and then was important to
02:50:59 us is a two hour response time. So if
02:51:02 the city gets notification that a device
02:51:04 Is improperly parked her there's an
02:51:08 issue with it, then we quickly get that
02:51:09 information over to the operator and
02:51:10 then from there the operator is part of
02:51:13 our program, we have two hours to
02:51:14 respond to that most likely just
02:51:15 picking up the device and taking it
02:51:17 back and dealing with itAnd get
02:51:22 follow-up that hasn't occurred, we will
02:51:23 be looking atPotentially impounding the
02:51:28 device with the help of our police
02:51:29 department, but we hope not to be there
02:51:30 and really it's more just making sure
02:51:32 That operators our expectation. Shared
02:51:36 parking and priority parking areas I
02:51:39 will talk about on the next two slides
02:51:40 with their some in length and I will
02:51:42 explain in the second hear what the
02:51:43 differences are. So shared parking zones
02:51:45 , You will see this, We are looking at
02:51:50 our shared parking zones preestablished
02:51:51 with the help of the city, the
02:51:55 commercial and institutional areas,
02:51:56 work with operators on infrastructure
02:51:57 cost of maintenance, we are not
02:52:00 anticipating a lot but you're going to
02:52:01 if you set a certain area there tends
02:52:02 to be issues that pop up, We would
02:52:05 require encroachment permitAnd we do
02:52:09 want to have the locations adjusted
02:52:10 over time. And that the city would be
02:52:14 able to review and approve these
02:52:15 designated parking locations.And what
02:52:17 I've seen in other cities isCertain
02:52:20 downtowns they will stripe out a
02:52:21 parking space and then put a P with a
02:52:26 circle around it and a little M1 above
02:52:27 a scooter or a bike and really just
02:52:30 trying to encourage people to park in
02:52:31 designated areas. Party parking areas
02:52:35 are areas within the city that we feel
02:52:36 should be prioritized as far asScooter
02:52:37 deployment, These are some the
02:52:40 commercial zones that you will see here
02:52:45 . We are getting a little bit of mix
02:52:46 response for some of the folks we've
02:52:47 talked to in theAreas, I think
02:52:48 everybody is interested in the tech
02:52:49 knowledge he cuts a question of whether
02:52:51 they want these on the property.And
02:52:56 then these are some of the other areas
02:52:57 we're looking at, obviously some city
02:52:58 facilitiesAnd as mentioned earlier, the
02:53:00 University and I believe the BTAAt the
02:53:02 train stations is interested, once
02:53:04 again, it does not interfere with their
02:53:07 facilities. So just the slightest
02:53:09 really coveringJust, and we made it a
02:53:19 point, these are what we believe are
02:53:20 the usage areas within the city.
02:53:21 Everything else we've been talking
02:53:22 about is parking, kind of getting into
02:53:23 very specific topicsThat are not really
02:53:24 kind of getting the picture, so we are
02:53:26 repeating some the state law here, was
02:53:29 important to recognize here is that
02:53:39 bullet three is, we've talked with our
02:53:40 parks department, there really not
02:53:41 interested in these departments
02:53:42 operating on parks itself, so we are
02:53:43 looking do not have these operate
02:53:44 through parksAnd then we want to make
02:53:45 sure that these adhere to the speed
02:53:46 limit on city trails, 15 miles an hour,
02:53:48 still discuss thatAnd of course no
02:53:51 writing on the sidewalks. And you can
02:53:52 see on that picture on the right you
02:53:54 can see devices parked and then in the
02:53:56 green bike lane, that's probablyThat's
02:54:06 -- that's kind of a nice synergy if we
02:54:07 are able to accomplish that. Fleet
02:54:08 management and balancing. It is good or
02:54:09 operator, believe they have to manage
02:54:10 their fleet appropriately is a business
02:54:11 and balance it accordingly, so this is
02:54:12 where did get a little bit of feedback
02:54:14 in terms of what we are looking at in
02:54:15 terms of minimums and maximums. So we
02:54:19 believe that a viable program by an
02:54:20 operator should have at least 60
02:54:21 scootersOr bicycles, whatever they
02:54:22 choose. And then a maximumCapital,This
02:54:30 cap when you go to different cities you
02:54:31 will see various caps, CAP up to 2500,
02:54:38 Other cities very, Santa Monica has
02:54:39 caps as well.2000 scooters, 1000 bikes.
02:54:44 We would have requirements for
02:54:45 redistribution for daily compliance.
02:54:47 Customer service and maintenance is a
02:54:48 key item here, We want to make sure that
02:54:50 users can appropriately notify the
02:54:58 operator of issues and in addition,
02:54:59 residents and other stakeholders can
02:55:00 get a hold of the company'sIn the city,
02:55:01 course, if issues do arise, once again
02:55:04 the devices must be in working condition
02:55:09 . We are interested in maintenance
02:55:10 information, Limited, but as requested.
02:55:13 So with education and outreach, this is
02:55:14 whereWe believe that if we are able to
02:55:17 properly educate writersAnd the public,
02:55:20 then we will get better feedback in
02:55:23 terms of how things are goingAnd making
02:55:25 sure thatThose are using these devices
02:55:29 are using them safely, so we do want to
02:55:36 try to push toward operators to ensure
02:55:37 compliance with laws on helmets,
02:55:38 parking,Speed and bike lanes. This is a
02:55:39 tricky topic because a company cannot
02:55:42 control exactly what a writer will do
02:55:45 but they can certainly educate them
02:55:46 over educate them, Get them to the
02:55:47 position where it's really not, I
02:56:02 didn't know, but more of I just decided
02:56:03 not to follow the law. So what we are
02:56:04 looking at here is four public outreach
02:56:05 events annually that would be
02:56:06 coordinated through the city, we are
02:56:07 happy to do that, and then what's
02:56:08 important is that the first event would
02:56:09 be prior to deployment and when that
02:56:10 initial deployment comes out we want to
02:56:11 have the operators staffed and ready to
02:56:12 participateAnd educate folks.Data
02:56:22 sharing, this is definitely something
02:56:23 that I believe this council is
02:56:24 interested in. We are of course
02:56:25 interested in itAs well as staff. We
02:56:26 want understandWhere trips are coming
02:56:32 from, whether going to, what people are
02:56:33 actually doing, we are interested in
02:56:34 maintenance, customer service, survey
02:56:35 data, we will push towardsHaving these
02:56:37 operators as part of the premier
02:56:38 requirements
02:56:46 : Give us data that we can use, not
02:56:51 give me an Excel file that I can't read
02:56:52 but give me information that is in a
02:56:53 certain format, we can pull up quickly
02:56:56 and look at trends, that is what we
02:56:57 believe is going to be importantAfter
02:56:58 initial rollout,To really see what we
02:57:03 should be doing differently, whether
02:57:04 these areas we talked about earlier
02:57:07 need to be adjusted, whether certain
02:57:08 routes that we need to focus on in
02:57:09 terms of ensuring compliance, etc.There
02:57:16 is a concern regarding privacy, so we
02:57:17 don't intend to violate anybody's
02:57:18 privacy, we would have to get that
02:57:19 informationWith anonymous tax, but once
02:57:22 again, we are really looking at trends.
02:57:28 Enforcement, obviously we hope to never
02:57:29 have to go to this route, but we do
02:57:30 have the ability to enforceState law
02:57:31 with relation helmets, Sidewalk writing
02:57:34 and it does happen, Do intend to impound
02:57:38 result safety issues if it goes beyond
02:57:41 two hoursWe are still working through
02:57:46 with the police department in terms of
02:57:47 the logistics of that. I believe public
02:57:58 works will play a role there but at the
02:57:59 end of the day, police is going to be
02:58:00 doing enforcement. Last but not least
02:58:01 is if an operator fails to comply and
02:58:02 there's a pattern, we have an
02:58:03 established those metrics yet, during
02:58:06 annual permit review we be looking at
02:58:07 whether we are new or not or permit
02:58:08 revocation.Insurance, sorry, in
02:58:11 Sherman's-- Insurance indemnification,
02:58:21 these are being worked on with our city
02:58:22 attorney's office, we do believe that
02:58:23 provider should have insurance, they
02:58:24 need to indemnify the city and meet the
02:58:25 limits that weBelieve are going to
02:58:26 protect the cityItself. We do intend to
02:58:29 run an annualPermit program and a lot
02:58:33 of this have sent been fleshed out yet,
02:58:34 once a year we have a call for people
02:58:35 wanting to apply, we set the deadline,
02:58:36 they apply, we review the applications
02:58:38 and then whoever successful gets a
02:58:39 permit, And would pay an application fee
02:58:47 And operating fees as well. What I did
02:58:48 want to focus on here little bit is
02:58:49 city cost. There was a recent
02:58:50 correspondence with some of the
02:58:51 operators regarding costs we have
02:58:52 brought upIn terms of one of the
02:58:53 outreach meetings. Our cost structure
02:58:54 has not been finalized at all. We are
02:58:56 looking at various cities to see what
02:58:57 they're doing, summer chargingWithin
02:59:00 the $20,000 range, some are charging
02:59:01 very low, Roughly $2500As a base fee
02:59:09 and roughly $100 per device. So we are
02:59:10 looking at the structure to make sure
02:59:11 the structureIs going to work for us
02:59:12 and then we are going to do our best to
02:59:16 recover as much city cost as possible.
02:59:17 City costs are going to involve
02:59:21 fermentative ministration, data
02:59:22 analysis, public interaction and
02:59:23 additional outreach.Last but not least
02:59:25 we have special events, soWith our
02:59:29 stadium here, we do want to recognize
02:59:32 that, this is a unique asset to have
02:59:35 and having that, Some of the regular
02:59:39 program retirements may not work, so we
02:59:41 are looking at potentiallyMaximum
02:59:45 Applying within the Vicinity of the
02:59:46 Stadium. We Are Looking at Obviously
02:59:47 ComplianceThe cities T mob for the
02:59:49 stadium, Operator should provide support
02:59:53 On site, thoseFrom our coordination
02:59:57 meeting with the 49ers, they would
02:59:58 monitorDevice locations, we would be
03:00:01 looking at a very short window for
03:00:02 response time for parking issues.
03:00:03 Geo-fencing was part of the discussion
03:00:04 because it's going to be helpful in
03:00:05 terms of helping designate parking
03:00:06 areas, etc.As far as next steps,
03:00:09 Wrapping up here, today's discussion,
03:00:12 We are really looking forward to

03:00:52 some of the logistics of how to roll
03:00:53 these devices out for our public.And

03:01:11 have talked about this, I had toPatch
03:01:15 back a studentWho used, Borrowed a
03:01:23 scooter and used his face to stop the
03:01:24 scooter in the wall.So I am very aware
03:01:26 of what can happen, five stitches later
03:01:29 he is fine.When we talk about an
03:01:34 outreach event, I can see something
03:01:37 that maybe we would provide a parking
03:01:39 lot, City parking lot and have the
03:01:44 vendor do a lot of this outreach, let
03:01:46 them do it. I could see events where we
03:01:49 would teach some students, Older
03:01:54 teenagers, hopefully, to drive better.
03:01:57 When we talk about there needs to be
03:02:02 Insurance and we talked about needing
03:02:03 to have a drivers license and or a
03:02:06 permit, it's state law if you have a
03:02:07 driving permitThat you have to carryCar
03:02:10 insurance. I'm wondering as a motorized
03:02:14 scooter if that's covered by that, I am
03:02:16 not certain.But that might be something
03:02:19 we could look atAs far asSome realities.
03:02:31 I like the idea, now one of our notes
03:02:32 said make certain that all the scooters
03:02:33 have speedometers. Because we are
03:02:36 worried about the speed limit.And I had
03:02:45 been watching a lot, going down in
03:02:46 downtown San Jose, looking at things, I
03:02:47 also was recently in Atlanta. And I
03:02:48 noticed downtownThat a bunch of the
03:02:51 hotels had put, It was just off the
03:02:55 public sidewalk butOn the hotel right
03:03:00 in front of scooter parking, And my
03:03:06 thought was oh, the convention center
03:03:07 library, some places whereIt's obvious,
03:03:10 But out of the way.SoI would like to
03:03:16 work with some of the vendors and look
03:03:21 at some of those places, that's why
03:03:22 wanted data so that we could see where
03:03:24 are these being used. Because when you
03:03:28 talk about making parking places, I am
03:03:31 uncomfortable with taking action --
03:03:37 actual parking places but there are
03:03:38 places in parking lots that are an
03:03:39 unusual shapeThe car won't fit.Also, if
03:03:42 you see motorcycle parking off to the
03:03:45 side, this could be a place. I thought
03:03:47 about this a lot.I appreciate all the
03:03:50 work. And one more thing for staff to
03:03:55 do. Thank you. Know with regards to
03:03:57 parking, our preference would be that
03:04:04 these devices be parked on private
03:04:05 property as much is possible with
03:04:06 limited situations where property owner,
03:04:12 It wouldn't work, the devices are
03:04:13 still being dropped off, so we want to
03:04:14 make sure that we corral them in
03:04:15 certain areas, that way they are not
03:04:16 all of the block. We are trying to
03:04:17 reduce the amountOf parking in the
03:04:19 street as much is possible, butThen
03:04:22 working with property owners. We had a
03:04:23 couple of goodMeetings, we are
03:04:29 interested, some of them have actual
03:04:30 relationships with some of these
03:04:31 companies, we will kind of seeHow those
03:04:32 play out with other operators as they
03:04:33 come in. But it seems very promising.

03:04:54 article or a story on the radio about
03:04:58 The programs.Let's see.I am curious, I
03:05:07 mean, well, if the city wouldReally
03:05:11 consider a bike sharing program,
03:05:14 because I understandA lot of cities have
03:05:20 , Companies have pulled out of cities
03:05:21 that had programs because they weren't
03:05:25 profitable. And it just seems like the
03:05:26 scooter sharing program is more
03:05:27 profitableAnd seems to be more useful
03:05:34 Than the bike sharing program. So I am
03:05:35 wondering if we would really look at
03:05:41 that kind of a program.
03:05:42 >>So we would. I mean, we deftly want
03:05:43 to encourageThat other type of mode,
03:05:45 scooters are not the be-all and end-all
03:05:49 At the end of the day, we do want to
03:05:50 encourage biking, we have a bike plan,
03:05:51 Make sure that people use our facilities
03:05:53 , What tends to bePart of these
03:05:59 companies profile is really electric
03:06:00 bikes which is a little different from
03:06:01 your normal bikeAnd of course some of
03:06:02 the bikes or dock lists, Some of them
03:06:03 are actually.. We are definitely
03:06:08 interested. There just hasn't been a
03:06:09 lot of interest here. You are correct
03:06:10 thatIn some cities, some of the share
03:06:12 companies have pulled outOf the bike
03:06:15 cited the operation just due to the
03:06:17 usage. Emigrate, okay.And then
03:06:23 regarding like even which companies we
03:06:24 would look at, I can't remember the
03:06:28 name of the company, but I just heard a
03:06:29 story on the radioIn the last couple of
03:06:31 days about a scooter that was left
03:06:35 outside of a restaurant and the battery
03:06:36 exploded while it was leftThere and so
03:06:42 The scooter company has actually pulled
03:06:43 outAs a result. And so I mean,I am sure
03:06:49 we would look into making sureThat they
03:06:51 are safeAnd what they, well, their
03:06:56 safety record isIn usage.

03:07:28 regarding stakeholder feedback, I would
03:07:29 say based onThe information you're
03:07:34 providing, it sounds like I mean,
03:07:35 program likeThis would definitely be
03:07:37 beneficial in the north side and
03:07:41 entertainment district whereThere is
03:07:44 just a lot going on right now. SoI
03:07:46 could see it being beneficialIn that
03:07:49 area. However, I am concernedStillWhen
03:07:57 you like looking at the priority
03:07:58 parking areas specifically, The
03:07:59 commercial zones, Icy river MarkIs
03:08:03 mentioned, And I have actually seen
03:08:09 bikes and scooters just abandoned
03:08:10 alreadyAnd River Mark, And I've made
03:08:15 outreach to like it wasBike, for
03:08:21 instance, never responded, and just
03:08:22 this morning I just happened to take a
03:08:23 look and I noticed that one of the
03:08:24 bikes was missing, One of the bikes is
03:08:28 gone now. But there are bikes just
03:08:29 dropped all over the north side of been
03:08:31 there for months now.And that kind of
03:08:36 Issue, I mean, it does give me concern.
03:08:40 Just being responsible, but I am glad
03:08:42 that you're looking at ways to ensure
03:08:44 that they are responsibleFor picking up
03:08:48 the bikes.Another concern I have is how
03:08:52 much staff timeIs going to be required
03:08:56 To ensureThat they are, that the
03:09:00 companies are being compliantIn picking
03:09:02 them upAnd just basically being
03:09:06 responsible, Not discarding them all
03:09:09 over the -- not discarding them all
03:09:18 over the place. Another question I have
03:09:19 is regarding the first and last mile
03:09:20 locations, do we have any ideas of
03:09:21 where they might be in terms ofBike or
03:09:22 scooter sharing?
03:09:31 >>We have a little bit of information.
03:09:34 I think when we have met with some of
03:09:35 the operators,They are really kind of
03:09:41 waiting for our draft regulations
03:09:42 before they would give us a lot of
03:09:43 detail. Some got-- I haven't got enough
03:09:44 detail to answer your question. Transit
03:09:47 is a big item. Getting people that last
03:09:48 mileTo light rail station or train
03:09:55 station is very important for us,
03:09:56 that's why we listed as one of our
03:09:57 priority areas to focus on. I know
03:09:59 there are some certain tech companies
03:10:00 that are interestedWhich is a question
03:10:03 making sure that we can cite these
03:10:04 correctly.So I think really for me the
03:10:06 last mileIn terms of what we would
03:10:09 focus on is really getting people from
03:10:11 To public transportationVersus getting
03:10:17 them directly back to their house,
03:10:18 right, because I mean we don't
03:10:20 Necessarily know where residents are
03:10:21 going to want to ride them in one of
03:10:23 the concerns we were initially
03:10:24 discussing wasKind of designating these
03:10:28 areas and residential areas for parking
03:10:30 , Which can be problematic as people
03:10:34 may not want, people congregating in
03:10:35 other homes with scooters knocking them
03:10:38 over and things like that. Know
03:10:44 exactly. Exactly. I like the idea of
03:10:45 having a minimum of scootersAnd bikes.
03:10:50 I think that's a good step.Let me see,
03:10:53 regardingEducation and outreach, And
03:10:59 also enforcement, Wood, are there any
03:11:04 cases where, for instance, and operator
03:11:08 Or a person using a scooter has been
03:11:10 ticketed for not followingOr being,
03:11:17 following the rules of regulations over
03:11:18 usage?
03:11:19 >>I believe there have been,If
03:11:23 somebody's intoxicated using these
03:11:24 devices is against the law, riding
03:11:25 without a helmet at a young age, Should
03:11:27 be dealt with appropriately. If you're
03:11:28 writing on the sidewalk,Cities, I
03:11:30 believe municipalities can deal with
03:11:31 that. I think it really just kind of
03:11:34 depends on the situation. I think there
03:11:36 are some stories out there in terms of
03:11:38 obviously accidents(inaudible). There's
03:11:43 a state law that governs how these can
03:11:44 operate in our rules are intended to
03:11:45 bolster those a little bit to be a
03:11:48 little more specific. We are not trying
03:11:49 toDo anything more, we're not trying to
03:11:52 replace state law, it's part of the
03:11:59 vehicle code, we are trying to since we
03:12:00 are going to have these relationships
03:12:01 with operatorsAnd have rules and
03:12:05 regulations that we want to be a little
03:12:06 more specific about what we are looking
03:12:07 for from our city.
03:12:08 >>Okay.And then under enforcement and
03:12:09 the permit revocation, Would weSet like
03:12:14 a certain number of violations, Have a
03:12:18 certain number of violations that would
03:12:19 be set, then, that would trigger
03:12:23 REMICADE heThe permit?
03:12:29 >>That would be the intent. We haven't
03:12:30 set the number yet. We would want to
03:12:32 work with some of the other cities to
03:12:33 see what they have doneWith regards to
03:12:34 that. But that it would be the
03:12:42 intention, to set some standards by
03:12:43 which people are supposed to behave in
03:12:44 and kinda make sure they are aware of
03:12:45 how that's supposed to happen. Then you
03:12:49 have to hold them accountable if it
03:12:50 does occur or they basically are in
03:12:51 violation of those standards.We are not
03:12:52 trying to penalizeOperators, but at the
03:12:55 end of the day, if the pattern isPretty
03:12:58 obvious, then those are easySituations
03:13:00 to deal with.We would like to work with
03:13:05 operators to resolve issues. So I think
03:13:13 Setting up the metric may be a little
03:13:14 tricky, but we're going to try to do
03:13:15 that is a part of the program.

03:13:34 looking at, is there going to be
03:13:36 Anything that could helpSome of the
03:13:40 larger centers where scooters are just
03:13:41 droppedAnywhere in the centersAt all
03:13:44 times? Or is it up to the property
03:13:47 owners? I think I might know the answer
03:13:52 to this, but is it up to the property
03:13:53 owner toPut together regulations within
03:13:55 their ownShopping center area
03:13:58 developmentsTo control that?
03:14:03 >>So as part of ourRoles, we do want to
03:14:14 set of standards by which the companies
03:14:15 are supposed to operate, so we do want
03:14:16 them to behave accordingly, but for
03:14:17 some reason they are placed withinLike
03:14:18 say a commercial areaAnd then they
03:14:22 don't respond, and those of the issues
03:14:23 that are part of the compliance, soThey
03:14:25 are parked inappropriately.It does get
03:14:30 a little tricky because relationships
03:14:31 between property ownersMaybe fine one
03:14:34 day and not find the next day. But we
03:14:37 would want to resolve that as much is
03:14:38 possible.When we come back in August we
03:14:42 will have more clarity on that.:Thank

03:15:11 a special thank you to cities staff,
03:15:13 Michael, Dennis and Ray Touche for
03:15:15 really being a great partner-- Partner
03:15:27 with bird working with us over the past
03:15:28 six months. We have come a long way
03:15:29 since that first meeting in the little
03:15:30 room. And now we are really developing
03:15:31 I think city of Santa Clara is
03:15:32 developing a programWhich is going to
03:15:34 be not just a local or state model but
03:15:35 a national model. And we are very proud
03:15:40 And a willing participant partnered in
03:15:41 this process. Just wanted to go over a
03:15:44 few thingsAnd I know that we are still
03:15:48 in the early stages, no we sent a
03:15:49 letter to each of you, Just around some
03:15:53 of our concerns, we are happy to
03:15:54 discuss those as well, more in depth,
03:15:55 but in terms of really looking at the
03:15:58 specifics, I know there is been
03:16:02 discussed a $20,000 application fee
03:16:04 Annual application fee, And that's in
03:16:08 addition to the per vehicle feeThat has
03:16:11 also been suggested as wellIn some of
03:16:15 those draft regulations. We would like
03:16:18 instead of our performance deposit to
03:16:23 do more of a performance bond.
03:16:25 Currently there is not a cityThat asks
03:16:30 us to do a $20,000 annual fee as wellAs
03:16:33 a vehicle fee, and then with the bond,
03:16:36 It's a very similar guaranteeCompared to
03:16:41 A deposit. There is also, I was looking
03:16:45 at different regulations and we
03:16:46 currently do notPut in any sort of
03:16:49 depositWith the city, however, we do do
03:16:55 bonds. We want to be able to make sure
03:16:56 that with the fees sometimes those fees
03:16:58 actually go backOn the writer. And we
03:17:02 don't want that to happen. We want to be
03:17:08 An equitable, accessible transportation
03:17:09 solution in Santa Clara. We don't want
03:17:12 to make this too expensive where people
03:17:13 will not use our product. Secondly,

03:17:53 concerned aboutSpeeding and obstructing
03:17:56 sidewalks and improper parkingIn
03:17:59 dangerous collisions and all those
03:18:00 things, What you really ought to be
03:18:03 clamping down on his cars. And shopping
03:18:08 carts and a few other things that I
03:18:09 find on the sidewalks. Both ends of my
03:18:10 commute are a mile from the nearest
03:18:13 transit stop. That's why ride my bike
03:18:17 most days, which is faster than getting
03:18:18 on the bus.I live 2 miles from Cal Tran
03:18:21 and 5 miles from any of a couple of
03:18:23 different light rail stations. Bike
03:18:27 share in scooters are a good option for
03:18:30 first and last mile trips and they
03:18:33 don't depend on my having a bike with
03:18:34 me and feeling secureLeaving it
03:18:35 somewhere.I went to a couple of the
03:18:41 Outreach meetingsFor the stuff that the
03:18:48 staff is talking about tonight. I think
03:18:50 if the public outreach from the scooter
03:18:54 companies is half as interesting is that
03:19:00 you're going to have nobody attending
03:19:01 or anybody who actually attends is
03:19:02 going to be exactly who you don't need
03:19:03 to reach.But I think it could be
03:19:04 effective if you included scooter
03:19:06 demonstration in something that's
03:19:08 already going onLike the open house
03:19:10 that was last week, There is a test
03:19:15 drive of for electric vehicles,
03:19:17 scooters and electric vehicle, Invite
03:19:20 them to that kind of thing.I noticed on
03:19:25 the list, most of our commercial and
03:19:26 priority parkingAreasAre places I would
03:19:32 say need better bicycle parking in
03:19:33 general. And most of all, if you want
03:19:35 to keep people on scooters off of
03:19:37 sidewalks, please improve the bicycle
03:19:41 network and implement the bicycle plan.
03:19:43 I think that's going to be the most
03:19:47 Useful thing to do as a practical
03:19:48 matter, you can write whatever law you
03:19:49 wantIf you don't have a decent bike
03:19:51 lane, but is going to ride on the street
03:19:54 instead of the sidewalk.

03:20:05 fan of shared bikes and scooters
03:20:06 because of a great way to reduce BMT
03:20:09 and greenhouse gases. It's really sad
03:20:11 That companies and the public are for
03:20:13 scooters over bikes because bikes are
03:20:15 way more safe because they have larger
03:20:16 wheels.I like the idea of geo-fencing.
03:20:22 What I would like to see is slower
03:20:23 speeds. I knowSan Jose State and
03:20:28 scooters, but we could impose slower
03:20:29 speed limits on the Santa Clara
03:20:31 University campusOr the Levi's parking
03:20:33 lot through geo-fencingAnd then I was
03:20:37 at the robotics lab when councilmember
03:20:40 Hardy had to patch up that kidAnd my
03:20:42 proposal is that we actuallyHave,
03:20:48 Because these things are pretty smart
03:20:51 And they work through your smartphone,
03:20:52 you can actually say beginners have a
03:20:54 lower speed limit. So if you have never
03:20:57 ridden the scooter before, Your limited
03:21:01 at 8 miles an hour. Then if you've
03:21:02 written it for maybeTwo hours, you can
03:21:05 go up to 12 miles. And then up to 15.
03:21:11 So I recommend that we have a beginners
03:21:12 speed.I think as part of, As far as the
03:21:17 fees go, we don't want to run these
03:21:23 Companies out of Santa Clara. I think
03:21:24 maybe we should be getting developers
03:21:25 to subsidize some of these feesThrough
03:21:27 their TDM plans because they have these
03:21:28 strict TDM plans, I've never seenOn
03:21:31 planning commission actually a TDM plan
03:21:33 come back with all the developments
03:21:37 we've approved. So I would like to see
03:21:38 what we are putting in those.And then I
03:21:41 noticed that other cities have tethering
03:21:43 , see of a little leash because
03:21:48 Delinquents will like take the spikes
03:21:51 and throw them into the street the
03:21:52 creeks so sometime's you want to tie
03:21:55 them to a fixed object.I think San
03:22:00 Francisco has that. And then I want to
03:22:01 see maybe the city to commit some
03:22:02 street parking spots for docking. I
03:22:05 didn't see in the proposals any
03:22:06 commission, commitment for that. Thank

03:23:31 over 18 need a helmetMore than people

03:23:39 request would be maybe to work with the

03:25:02 fund the convention center complex
03:25:03 maintenance district.That means
03:25:08 maintenance district is comprised of
03:25:09 the convention center, the Hyatt as
03:25:10 well tech Mark and so on April 9, We
03:25:12 adopted a resolution established tonight
03:25:14 as a public hearing. So the total
03:25:15 assessmentFor 1920 isJust under$1.7
03:25:19 million, it's approximately $135,000
03:25:24 Over last year's assessment and that's
03:25:26 due primarily to someIncreases obviously
03:25:31 In labor with some of our contracts,
03:25:32 but also we haveA paving project out
03:25:35 there to rehabilitate some of the
03:25:36 parking areas.Since it is an increase,

03:28:53 assessment includes the flat rate$14,200
03:28:59 , but then we also subtract out any
03:29:00 interest from the account, And so with
03:29:01 that, subtraction, the total assessment
03:29:04 came to 11,000 or hundred and $41,
03:29:08 Which is shared amongst the property
03:29:09 owners. The city will also be
03:29:14 contributing funding in the amount of
03:29:15 approximately 168,000Dollars which will
03:29:20 cover general maintenance and
03:29:21 operations of Franklin Square. So staff
03:29:22 is recommendingThat Council adopt
03:29:23 resolution tonight overruling any
03:29:24 protestsLevied the '19-20 Mac
03:29:30 assessment and approve the director's

03:33:26 world-famous Achilles restaurant in
03:33:27 Santa Clara and if that's not enough,
03:33:33 they have dessert from the world-famous
03:33:34 readers, the custard ice cream, which
03:33:35 is really delicious and Santa Clara. So
03:33:36 Don Weeden, Achilles, and Rita's ice
03:33:39 cream is quiteA party tomorrow, so 6:00

03:34:18 talk aboutJohn they really thought up
03:34:22 brought up some of the things that he
03:34:23 pioneeredIn the city of Santa Clara
03:34:30 which are now have become things like
03:34:31 about the way that we do power
03:34:32 management agreements and some other
03:34:33 practicesThat utilities all over the
03:34:35 U.S. are using now that were things
03:34:36 that John put togetherAnd brought, SVP
03:34:42 really pioneered the way. I thought it
03:34:43 was really great to be there for him to
03:34:44 get that awardAnd I am joining the
03:34:45 board of direct others in that
03:34:47 organization, soIt will be a good
03:34:50 opportunity to work more closelyWith a
03:34:52 lot of our kind of other public
03:34:54 utilitiesIn the Western states. So I
03:34:58 look forward to that opportunity.

03:35:33 disabilitiesAnd they did a wonderful

03:35:37 mood for summerAnd it's one ofThe
03:35:40 biggest fundraiser of ends-- Events, I
03:35:48 highly recommend when they have their
03:35:49 event next year that we support it. It
03:35:50 was definitely worth my timeAnd hearing
03:35:53 everybody sing and the crowd, they had

03:37:29 with a landscaping contractor who is
03:37:31 Assessing the condition and I think we
03:37:34 may be made some bad choices a couple
03:37:35 of years ago when we ripped all the
03:37:36 plants out and putAll the weed coughed
03:37:39 in and all that. So stay tuned, Those
03:37:41 pumping stations will be looking better

03:38:11 Melanie was born on March 4, 1946 in
03:38:12 Niagara Falls, New York. She graduated
03:38:13 from La Salle Senior high school in
03:38:17 1964. Melanie received her associate of
03:38:18 arts degree fromNiagara County, sorry,
03:38:24 Niagara County community College in 1967
03:38:27 . In the summer of 1967, she married
03:38:28 John George and they moved to Omaha,
03:38:34 Nebraska. In 1971, Melanie John and
03:38:35 their young daughters moved to the bay
03:38:36 area. Melanie began working for the
03:38:40 Santa Clara unified school district in
03:38:41 1978 as an instructional assistant at
03:38:44 Catherine Hughes elementary school. She
03:38:49 later worked at Scott Lane elementary
03:38:50 school in both mainstream and's Peschel
03:38:51 education. Her when her daughter for
03:38:55 older she took a full-time position as
03:38:56 a receptionist at the school district
03:38:57 office. Melanie retired from the Santa
03:39:01 Clara unified school district in 2002.
03:39:04 She passed away on May 14. She passed
03:39:07 away on May 14, 2019, at the age of 73.
03:39:11 Melanie is survived by her daughters,
03:39:12 Leslie close of Santa Clara and Merrill
03:39:13 Turner of Capitola. Her grandchildrenAs
03:39:21 we all know them, Carolyn and Vincent
03:39:22 close, are just commissioners of Santa
03:39:23 Clara, sister-in-law Rosemary Gleason
03:39:24 of GreensboroNorth Carolina and
03:39:28 brother-in-law Joseph George of Niagara
03:39:29 Falls New York, She was really, really
03:39:32 a wonderful person.Sad for her family.
03:39:39 Also, we would like to adjourn in the
03:39:40 memory of Donald Dawn Francis Lombardi.
03:39:45 Don was born on July 3, 1935, He moved
03:39:49 to Santa Clara County in 1958 and open
03:39:53 Lombardi's auto service in 1959. He was
03:39:55 a mainstay in the community for over 60
03:39:57 years, An avid fisherman and a caring
03:40:01 man. Don was deeply involved in the
03:40:04 lives of his family and friendsAnd will
03:40:06 leave a lasting impactFor years and
03:40:09 generations to come.Don passed away on
03:40:12 May 10, 2019At the age of 83. He is
03:40:18 survived by his siblings, Dorothy,
03:40:20 Alexander, Viola and Julia, his loving
03:40:24 children, Donnie and Kathy, his four
03:40:28 grandchildren and three
03:40:29 great-grandchildren, and I think we all
03:40:30 knowDon, Mr. Lombardi used to come to
03:40:31 the CouncilAnd talk to us about certain
03:40:35 things in the community, he would write
03:40:40 as very spirited letters about a lot of
03:40:41 things in the community but the most
03:40:42 important part, He held as accountable
03:40:44 for a lot of things and one of the
03:40:45 things he talked about mostWas the El
03:40:47 Camino Rialto in the repaving of the El
03:40:49 Camino Riau, soMr. Lombardi, know that
03:40:54 it's happening and every time I think
03:40:55 aboutThe El Camino Riau paving I think
03:41:00 of Mr. Lombardi. So we are very, very
03:41:01 sad for his familyAnd to see that he
03:41:02 passed.Next, we haveBilly RayHewitt,
03:41:12 retired city of Santa Clara Parks and
03:41:13 Recreation Department employee.Billy
03:41:16 was born on January 27, 1937. He
03:41:20 graduated from East Bakersfield high
03:41:21 school. Billy enlisted in the Navy in
03:41:23 February1955 and was discharged in
03:41:33 January 1963. He later continued his
03:41:34 education by attending: go to community
03:41:35 college in San Jose State University.
03:41:37 Billy retired from the city of Santa
03:41:38 Clara Parks and Recreation Department
03:41:40 as a Park foreman in May, 1995With over
03:41:43 32 years of public service. He enjoyed
03:41:49 Birdwatching, visiting Morro Bay and
03:41:50 spending time with his family. Billy
03:41:51 passed awayOn May 11, 2019At the age of
03:41:55 82. He is survivedBy his loving wife,
03:42:00 Janine, daughters Pamela and page, 10
03:42:02 grandchildrenAnd 12 great-grandchildren.
03:42:07 We are sorry for theFamily. I would
03:42:10 also likeTo adjourn in the memory of
03:42:16 the victims of the shooting at Virginia
03:42:17 BeachInvisible center in Virginia
