Adoption of a Resolution Ordering the Vacation of Electric Easements at 1525 Alviso Street

BACKGROUND
Pulte Home Company is currently in the process of constructing 40 condominium units at 1525 Alviso Street. The project was approved by Council on January 12, 2016.
DISCUSSION
Due to the redevelopment of the property located at 1525 Alviso Street, the electric easement encumbering the property has been relocated or determined to be excess, and is no longer necessary. To clear the unnecessary encumbrance on the property, the property owner is now requesting that the City vacate the easement. Staff reviewed the request and recommends that Council approve vacation of the easement.
ENVIRONMENTAL REVIEW
The potential environmental impacts of the project were addressed in the Mitigated Negative Declaration prepared for the project and approved by Council on January 12, 2016.
FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

This report has been coordinated with Silicon Valley Power and the City Attorney’s Office.

RECOMMENDATION
Recommendation
1. Adopt a resolution ordering the vacation of the electric easement located at 1525 Alviso Street [APN 224-29-012, 032, and 034 (2017-18); SC 19,047]; and
2. Authorize the recordation of the Resolution.
