BACKGROUND
On April 21, 2009, City Council approved the Rezoning, Environmental Impact Report (EIR), and Mitigation Monitoring and Reporting Program (MMRP) for an office/retail project located at 2350 Mission College Boulevard (Property). The applicant is currently in the process of constructing the project, which includes two, six-story office buildings totaling 300,000 square feet with potential for 25,000 square feet of ground floor retail; a 6,000 square foot retail building; a six-level parking garage; and on-site circulation, surface parking, and landscape improvements on the Property.
DISCUSSION
Due to the redevelopment of the Property, the existing underground electric easement, sidewalk, and utility easement encumbering the Property have been relocated or determined to be excess, and these easements are no longer necessary. The owner has requested that the City vacate the subject easements to clear these unnecessary encumbrances on the Property. Any relevant facilities previously within said easements have been removed or abandoned. The City departments having an interest in the easements, Silicon Valley Power, the Water and Sewer Utility Department, and the Department of Public Works, concur that these easements are eligible to be vacated. Staff has reviewed this proposal and found that these easements are no longer necessary for public purposes and therefore recommend that they be vacated according to subsection C of California Streets and Highways Code Section 8333.
ENVIRONMENTAL REVIEW
The potential environmental impacts of the project are addressed in the EIR and MMRP that were approved by the City Council on April 21, 2009.
FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.
COORDINATION
This report has been coordinated with the City Attorney’s Office, Silicon Valley Power, and the Water & Sewer Utility Department.

Recommendation
1. Adopt a Resolution Ordering the Vacation of an Underground Electric Easement, Sidewalk and Utility Easement at 2350-2370 Mission College Boulevard [APN 104-13-097,100 and 101 (2021-22); SC 18,978]; and
2. Authorize the recordation of the Resolution.
