BACKGROUND
On October 16, 2019, Architectural Review Committee approved the 2200 Calle De Luna Development project (Project) located at 2200 Calle De Luna (Property). The Project consists of a 580-unit, three tower residential project on 3.9 acres as part of the Tasman East Specific Plan.
DISCUSSION
Due to the redevelopment of the Property, the existing Storm Drain Easement, Street and Utility Easement, Wire Clearance Easement, and Electric Easements encumbering the Property have been relocated or determined to be excess, and these easements are no longer necessary. The property owner (Holland Partner Group) has requested that the City vacate the subject easements to clear these unnecessary encumbrances on the Property. Any relevant facilities previously within said easements or portions to be vacated have been removed or abandoned. All departments and agencies having an interest in the easements concur that the easements are eligible to be vacated. Staff has reviewed this proposal and found that these easements are no longer necessary for public purposes and therefore recommend that they be vacated according to subsection C of California Streets and Highways Code Section 8333.
ENVIRONMENTAL REVIEW
The potential environmental impact of the Project was addressed in the EIR approved by the City Council on November 13, 2018 (Agenda Item 9) and the EIR addendum approved by City Council on November 17, 2020 (Agenda Item 3).
FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.
COORINATION
This report has been coordinated with the City Attorney’s Office, Water and Sewer Utilities Department, and Silicon Valley Power.

Recommendation
1. Adopt a Resolution Ordering the Vacation of a storm drain easement, street and utility easement, electric easement, and wire clearance easement at 2200 Calle De Luna [APN 097-01-039 (2022-23), SC23-0051];
2. Adopt a Resolution Ordering the Vacation of an electric easement at 2200 Calle De Luna [APN 097-01-039 (2022-23), SC23-0052]; and
3. Authorize the recordation of the Resolutions.
