BACKGROUND
On February 13, 2023, the City approved a design professional services agreement with Westwood Professional Services, Inc. (Consultant) for the first phase of the Warburton Park Playground Rehabilitation Project (Project). The first phase of the Project includes preparation of concepts for the park and a schematic design for the playground rehabilitation, community outreach, presentation of the schematic design to the Parks and Recreation Commission, and action from the City Council. The proposed schematic design incorporated feedback from both the Parks and Recreation Commission and the community and was approved by Council on May 13, 2025 (RTC 25-195). The second phase of the Project includes various design professional services related to design and construction of the Project.
DISCUSSION
The proposed Amendment No. 1 (Attachment 1) includes a negotiated scope of services and schedule of fees that incorporates the design professional services necessary to complete the second phase of the Project, per the approved schematic design. The scope of services generally includes preparing bid documents (plans, specifications, and engineer’s estimate) for public works bidding, providing assistance with coordinating and securing permits, and providing services during project advertisement and construction.
Staff recommends the approval of Amendment No. 1 to the Agreement with Westwood Professional Services, Inc. Approval of this amendment will provide the professional services necessary to complete the design of the Project and proceed to construction in a timely manner. Design of the Project is anticipated to be completed by summer 2026. The agreement includes a section covering prevailing wage requirements.
ENVIRONMENTAL REVIEW
This action is for design professional services and the action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act ("CEQA") Guidelines section 15378 as the action being considered does not commit the City to undertake any project and future discretionary approvals are required by the City to approve any project for construction. Environmental review in accordance with CEQA will occur as part of the design and approval process. It is expected that the CEQA determination for this project will be a categorical exemption pursuant to CEQA Guidelines section 15301(c) Existing Facilities since the scope of work is maintenance/repair and minor modifications of existing facility.
FISCAL IMPACT
The proposed Amendment No. 1 increases the total not-to-exceed amount by $430,520 (from $128,425 to $558,945), which includes $491,115 for basic services and $67,830 for additional services. The Warburton Park Playground Rehabilitation project has sufficient funding in the Parks and Recreation Capital Fund.

This report has been coordinated with the Parks & Recreation Department, Finance Department and the City Attorney’s Office.

RECOMMENDATION
Recommendation
1. Approve and authorize the City Manager to execute Amendment No. 1 to the Agreement for Design Professional Services with Westwood Professional Services, Inc. for the Warburton Park Playground Rehabilitation Project in the amount not-to-exceed $558,945 in a final form approved by the City Attorney; and
2. Authorize the City Manager or designee to make minor modifications, including time extensions, to the Agreement, if needed.
