Twelve-Month Review of a Conditional Use Permit for Whole Foods Market at 2732 Augustine Drive

BACKGROUND

On February 8, 2017 the Planning Commission approved a Use Permit (PLN2016-12429) to allow the on-site sale and consumption of alcoholic beverages consisting of beer, wine and distilled spirits (Alcohol Beverage Control (ABC) License Type 47) for the existing brewery in Whole Foods Market.  The Use Permit allows the sale of beer, wine and distilled spirits during the regular business hours of 8:00 a.m. to 11:00 p.m. daily.  Six and twelve-month reviews are required as a condition of the Use Permit approval (attached) following the activation of the ABC License.  The ABC License was issued to the applicant on April 6, 2017.

 

The 7,009 square foot brewery is located on the eastern side of the Whole Foods Market in the Irvine Company’s Santa Clara Square development.  The surrounding land uses are comprised of high-intensity offices, and commercial and mixed-use residential development. The attached Project Data Sheet provides an aerial map for reference.

 

DISCUSSION

Since the issuance of the ABC license on April 6, 2017, there were no calls for service received by the City’s Police Department related to the subject use.  No zoning code violations are pending related to the subject use.  All conditions of approval have been satisfied.  Based upon the evidence available to staff, all activities are being conducted consistent with the intent and purpose of the issued Use Permit so that there is no justification for a modification of the Use Permit at this time.

 

ENVIRONMENTAL REVIEW

Use Permit review is not a project under CEQA and is exempt from the CEQA environmental review requirements per CEQA Section 15061(b)(3). The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility the activity in question may have a significant effect on the environment.

 

FISCAL IMPACT

There is no impact to the City for processing the requested application other than  administrative staff time and expense typically covered by processing fees paid by the applicant.

 

COORDINATION

This report has been coordinated with the City Attorney’s Office and the Police Department.

 

PUBLIC CONTACT

On June 1, 2018, the notice of public hearing for this item was posted within 300 feet of the site and was mailed to property owners within 300 feet of the project site. At the time of preparation of this staff report no comments related to the proposal were received from the public.
