BACKGROUND
The City Attorney has an employment agreement with the City. The employment agreement contains the following:
4. Performance Appraisal: The City Council shall formally review and evaluate Employee’s performance by December of each year.
It is recommended that a professional facilitator be retained to mediate the process and provide a comprehensive summary of the results.
DISCUSSION
On April 21, 2021, the City Council met in closed session to interview a candidate to serve as the performance evaluation facilitator for the City Attorney’s annual performance evaluation process. Following the closed session, the council reported out that the Council had authorized the Mayor to negotiate an agreement to retain the candidate’s consulting firm. The Mayor conducted the negotiation and reached an agreement with the candidate’s firm.
The facilitator is Jan Perkins, Vice President of Management Partners. Jan has worked with the City before and has over 30 years of local government management experience. She works with senior local government managers and elected officials to conduct performance evaluations, develop budget policy, conduct organizational assessments, and more. She has worked with cities and counties across California and beyond. Her experience and professionalism, as well as her familiarity with the City, makes her particularly qualified to facilitate the City Attorney’s annual evaluation process. The timing of the performance evaluation will be in the Summer of 2021.
It is recommended that the Council approve the contract between the City and Management Partners, attached for the Council’s consideration.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(4) in that it is a fiscal activity that does not involve any commitment to any specific project which may result in a potential significant impact on the environment
FISCAL IMPACT
The total cost of the Agreement for Services with Management Partners for facilitation of the performance evaluation process for the City Attorney is $12,900, which includes individual interviews with City Councilmembers, administration of a confidential questionnaire, and a final memorandum summarizing the agreements and results of the performance evaluation. There are sufficient funds in the City Attorney’s budget to cover this cost.
