Action on Amendment No. 1 to an Agreement with Yosh Enterprises, Inc., dba Orion Security for Security Guard Services at the Central Park Library

BACKGROUND
In July 2015, the City of Santa Clara Library Department issued a Request for Proposal (RFP) for security guard services at the Central Park Library. The Central Park Library is ~143,000 square feet comprised of two floors for staff and public use and an underground parking garage. The Central Park Library is open seven days a week with an average of 2,000 patrons visiting daily. Due to the large volume of visitors, adjacency to Central Park, the underground enclosed parking garage, and the vast size and complexity of the building, the Central Park Library requires the use of security guard services. On October 27, 2015, Council approved a three-year agreement with Yosh Enterprises, Inc., dba Orion Security for services through September 30, 2018 with a not to exceed amount of $205,750.
DISCUSSION
In order to allow sufficient time to develop a Request for Proposal and compete for a new contract, staff recommends approval of Amendment No. 1 (Attachment 1). The amendment would extend the Original Agreement term by twelve months, retroactive to October 1, 2018 through September 30, 2019 and increase the total not-to-exceed compensation by $90,000 from $205,750 to $295,750. Staff planned to have this amendment come forward for Council consideration in September, however negotiations were not started in time and this action was delayed by a month.
This Amendment allows the City to continue to provide patrons and staff with security services that will:
1) Protect the Library building, equipment, personnel, and materials
2) Ensure that the Library is a safe and pleasant environment for patrons and staff
3) Enforce Library policy for Public Rules of Conduct
4) Provide an appropriate level of customer service to visitors and staff members
5) Provide a presence at the Central Park Library to deter criminal activities and
disruptive behavior.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
FISCAL IMPACT
Funding in the amount of $90,000 for Amendment No. 1 is available in the Library Department’s FY 2018/19 budget.

This item was coordinated with the Finance Department and the City Attorney’s Office.

Approve and authorize the City Manager to execute Amendment No.1 to the Agreement with Yosh Enterprises, Inc., dba Orion Security in the amount of $90,000 for a total not-to-exceed amount of $295,750 for security guard services at the Central Park Library.
