BACKGROUND
On August 24, 2021, City Council approved a design professional services agreement with NUVIS Landscape Architecture, Inc. (NUVIS) to complete the first phase of the Central Park New Entrance, Access, and Parking Improvements Project (Project, RTC 21-627). The first phase of the Project includes conducting site assessment and investigation, performing community outreach, preparing schematic design, and presenting the proposed schematic design to the Parks & Recreation Commission and City Council. The schematic design was presented to the Parks & Recreation Commission on June 21, 2022 (RTC 22-793). The schematic design is scheduled for City Council approval on September 27, 2022 (RTC 22-1003). Upon approval of the schematic design, the design consultant agreement with NUVIS (Agreement) needs to be amended to include work to be performed in the second phase of the Project to include various engineering services related to design and construction of the Project. It should be noted that the Request for Proposal (RFP) for the Project included both phases of the Project, and consultant selection was based on responses related to both phases.
DISCUSSION
The proposed Amendment No. 1 to the Agreement (Attachment 1) includes a negotiated scope of services and schedule of fees that incorporates the engineering design services necessary to complete the second phase of the Project, per the approved schematic design. The scope of services generally includes preparing bid documents (plans, specifications, and engineer’s estimate) for public works bidding, providing assistance to coordinate and secure various permits, and providing engineering technical services during project advertisement and construction.
Staff recommends approval of Amendment No. 1 to the Agreement with NUVIS Landscape Architecture, Inc. to complete design services needed for the Central Park New Entrance, Access, and Parking Improvements Project. Approval of this amendment will provide the design professional services necessary to complete the design of the Project and proceed to construction in a timely manner. Design of the Project is anticipated to be completed by fall 2023 and construction of the Project is anticipated to be completed by fall 2025. Prevailing wage requirements that were included in the original agreement remain applicable under Amendment No. 1.
ENVIRONMENTAL REVIEW
Council action on this item does not constitute a “project” within the meaning of the California Environmental Quality Act ("CEQA") because it is an administrative activity that will not result in direct or indirect physical changes in the environment as set forth in section 15378(b)(5) of the CEQA Guidelines.
FISCAL IMPACT
The not-to-exceed amount under the original Agreement is $148,305. This amount includes $128,961 for basic services and $19,344 for additional services. The proposed Amendment No. 1 adds $255,695 to the original agreement, bringing the total not-to-exceed amount to $404,000 ($366,926 for basic services and $37,074 for additional services). Funding is available in the FY 2022/23 Adopted Capital Budget in the Central Park Master Plan - New Entrance, Access, and Parking Improvements CIP Project. (CIP 3133)

Recommendation
1. Approve and authorize the City Manager to execute Amendment No. 1 to the Agreement with NUVIS Landscape Architecture, Inc. in the amount of $255,695 for the Central Park New Entrance, Access, and Parking Improvements Project for a total Agreement not-to-exceed amount of $404,000; and
2. Authorize the City Manager to make minor modifications to the agreement if needed and to extend the term.
