BACKGROUND
On July 7, 2024, Committee member Clark Seninger submitted his resignation from the Bicycle and Pedestrian Advisory Committee effective immediately (Attachment). On July 1, 2024, Commissioner McNamara submitted his resignation from the Cultural Commission effective immediately (Attachment). Both resignations have created a vacancy on the Bicycle and Pedestrian Advisory Committee for a partial term ending June 30, 2027 and on the Cultural Commission for a partial-term ending June 30, 2028.
On both May 13 and 14, 2024 the Council conducted interviews for the Bicycle and Pedestrian Advisory Committee and Cultural Commission. The Council established an eligibility list from those interviewed which is set to expire in November, six months from the date the list was created. The council voted and approved an automatic appointment of Hung Duong should a vacancy occur on the Bicycle and Pedestrian Advisory Committee. The council also voted and approved Hung Duong and Swami Krishnamoorthy be placed on the eligibility list should a vacancy occur on the Cultural Commission. Staff reached out to both Hung and Swami to inquire if there was still an interest to serve on the Committee/Commission. Both affirmatively expressed an interest to serve.
DISCUSSION
Staff recommends accepting the resignations submitted by Committee member Clark Seninger and Commissioner Paul McNamara and declare a vacancy on the Bicycle and Pedestrian Advisory Committee and the Cultural Commission. Staff recommends appointing from the Council approved eligibility list: Hung Duong to the Bicycle and Pedestrian Advisory Committee to fill a partial-term ending June 30, 2027 and Swami Krishnamoorthy to the Cultural Commission for a partial term ending June 30, 2028.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
FISCAL IMPACT
There is no additional cost to the City other than administrative staff time and expense.

Recommendation
Accept the resignation of outgoing Committee member Clark Seninger and Commissioner Paul McNamara effective immediately; declare the vacancy on the Bicycle and Pedestrian Advisory Committee and Cultural Commission; and appoint from the Council approved eligibility list: Hung Duong to the Bicycle and Pedestrian Advisory Committee to fill a partial-term ending June 30, 2027 and Swami Krishnamoorthy to the Cultural Commission for a partial term ending June 30, 2028.
