BACKGROUND
CalRecycle has established various payment programs and grant opportunities that require governing bodies to declare by resolution certain authorizations related to the administration of the program. On May 16, 2016 the City Council adopted Resolution 16-8324 (Attachment 1) which authorized the City Manager (or designee) as the Signature Authority to submit applications for all payment programs offered by CalRecycle until rescinded by the Signature Authority or Council.
CalRecycle opened the Senate Bill 1383 (SB 1383) Local Assistance Grant Program (LAGP) application filing period on January 10, 2022 to help local jurisdictions fund efforts to reduce the amount of organics disposed in landfills as required by the regulations. In order to be eligible for the first round of funding, each applicant is required to submit an approved Resolution and Letters of Designation and/or Authorization by March 1, 2022. First round awardees may be eligible to receive additional remaining funds from entities who do not apply for funding. Applications that are submitted without a valid Resolution in place by March 1 will be deferred to the second funding round. A Resolution is still necessary to receive funding in the second round. Second round awardees will not be eligible to receive funds from entities who did not apply.
DISCUSSION
The Department of Public Works (DPW) has submitted a non-competitive grant application to receive $172,504 through the LAGP. The funds will be allocated to the Solid Waste Fund operating budget and be used to purchase materials/products derived from recycled organic material to satisfy a portion of the SB 1383 procurement requirements. The grant funds received during the first funding round must be spent by April 2, 2024.
The LAGP stipulates that the Resolution and Signature Authority documents submitted with the application be no older than five years. Resolution 16-8324 does not have a termination date, but it is older than 5 years, so an updated Resolution will need to be submitted by March 1 to be eligible for first round of funding. The proposed Resolution (Attachment 2) rescinds the authority to submit applications and the Signature Authority granted to the City Manager in Resolution 16-8324. It also authorizes the City manager as the Signature Authority to submit applications and reports for all grants and payment programs offered by CalRecycle through February 22, 2027.
ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(4) in that it is a fiscal activity that does not involve any commitment to any specific project which may result in a potential significant impact on the environment.
FISCAL IMPACT
There is no fiscal impact associated with this action.
