BACKGROUND
The Related Santa Clara project contemplates the construction of up to 9,100,000 square feet of retail, food & beverage, entertainment, hospitality, office and residential uses on approximately 240 acres of City-owned land previously used as Santa Clara Golf & Tennis Club and the Tasman Lots at Tasman Drive and Centennial Boulevard.
On June 28, 2016, Council authorized a series of actions (Project Approvals) for the Related Santa Clara project which among other actions included: adoption of an Environmental Impact Report (EIR) and statement of overriding considerations; approval of a Disposition and Development Agreement (DDA); Development Agreement (DA); and approval of a Master Community Plan (MCP).
Due to the limited existing roadway infrastructure in and around the project site, new vehicle, bicycle and pedestrian connections were needed to allow for the commencement of Phase I of Related Santa Clara project while continuing to maintain access to the Great America Train Station, the Youth Soccer Park, the Northside Receiving Station, and the loading docks for Levi’s Stadium. The Project Approvals contemplated the construction of this new infrastructure.
Related Santa Clara has been constructing the new improvements through permits issued by the City. These improvements include (Attachment 1):
• One-way exit ramp from east-bound Tasman Drive to Stars & Stripes Drive (at Transit Center), with a two-way bicycle path and pedestrian improvements;
• A new temporary road extending the existing Stars & Stripes Drive from the Transit Center across the former golf course to a new temporary intersection at Great America Parkway; and,
• Transit Center improvements to accommodate a turn around and shuttle buses for Great America Station.
All of the new improvements above will be ready to open to the public on August 3, 2020.
The proposed Temporary Road Maintenance Agreement (Agreement) provides that Related Santa Clara will be responsible for all the maintenance associated with the new temporary Stars & Stripes Drive extension from the Transit Center to Great America Parkway.
DISCUSSION
The Agreement identifies the responsible party (City or Related Santa Clara) for the maintenance of the temporary road.
The City will be responsible for the maintenance and repair of the traffic signals and cameras at the temporary intersection of Stars & Stripes Drive and Great America Parkway. The City will also be responsible for the maintenance of the permanent improvements at the Transit Center and the new one-way exit ramp from eastbound Tasman Drive to Stars & Stripes Drive.
Related Santa Clara will be responsible for preventative and operational maintenance of the new temporary road. These obligations include but are not limited to:
Preventative Maintenance
• Sweeping
• Maintenance of bio-retention areas
• Trash and Debris accumulation
• Storm Water Controls
• Vegetation Control
Operational Maintenance
• Pothole damage repairs
• Settlement repairs
• Light poles and electricity
• Graffiti removal
• Striping and repainting
• Fencing
• Signage
Under the Agreement, Related Santa Clara will be required to maintain the Temporary Road until one or more of the permanent roads within the new Related Santa Clara project has been opened for public use and the City has determined that the road(s) are sufficient to provide permanent access to the surrounding uses.
The provisions of the Agreement related to the landfill has been coordinated with the recent Council-approved Landfill Operation and Management Agreement. The Agreement makes Related responsible for any damage to the landfill or enhanced landfill maintenance costs resulting from the temporary Stars & Stripes Drive.
A separate item on the July 13, 2020 Council agenda closes public access to Centennial Boulevard and the section of Stars & Stripes Drive from the Tasman Garage to the vicinity of the Transit Center. The new roadway will connect the remaining section of Stars & Stripes Drive from the Transit Center to Great America Parkway. Streets and Highways Code Section 5026 provides that the City Council may by resolution change the name of any street located within the City. Adoption of the attached Resolution would formally name the new roadway extension to Stars & Stripes Drive.
ENVIRONMENTAL REVIEW
The project was analyzed in accordance with the requirements of the California Environmental Quality Act (CEQA) in the CityPlace Santa Clara EIR [SCH #2014072078] as certified and adopted by Council on June 28, 2016 by Resolution No. 16-8337.
FISCAL IMPACT
Costs associated with the maintenance of the new permanent improvements (Tasman Drive off ramp and Transit Center) will be absorbed in the Public Works Streets Division.
All other costs will be borne by Related Santa Clara.
COORDINATION
This report has been coordinated with the City Attorney’s Office and Public Works Department.

Recommendation
1. Approve and authorize the City Manager to execute a Temporary Road Maintenance Agreement with Related Santa Clara regarding maintenance obligations for a new public road extending Stars & Stripes Drive to Great America Parkway.
2. Adopt a Resolution naming the new public road Stars & Stripes Drive.
