Action on a Resolution Dedicating a Portion of City-Owned Land Located at the Southwest Corner of El Camino Real and Jackson Street for Use as an Underground Electric Easement

BACKGROUND
The City owns a strip of land approximately 25-foot by 90-foot at the southwest corner of El Camino Real and Jackson Street as shown in Attachment 2 entitled, ‘Location Map’. This piece of property is a remnant from a Caltrans El Camino widening project that took place during the 90’s. Currently, the property is vacant, covered with tanbark, and fronts an existing retail business on El Camino Real. The City has existing Silicon Valley Power electric underground utility facilities within the subject property. These facilities, consisting of an electric duct bank and underground vault, were constructed in the early 1990s, and reside in City property without the benefit of an easement. Although there is no current interest in the subject property, due to the potential for future sale as the property is vacant, staff has identified the need for an underground electric easement to be dedicated and recorded.
DISCUSSION
Dedication and recordation of the proposed underground electric easement will serve constructive notice to all parties who are interested in the title to the subject property. Approval of the resolution will document the location of the underground electric utility facilities and prevent private parties from building over the facilities if the property is sold.
ENVIRONMENTAL REVIEW
This action being considered is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15301, Existing Facilities.
FISCAL IMPACT
There is no additional cost to the City other than administrative staff time and expense.
COORDINATION
This report has been coordinated with Silicon Valley Power and the City Attorney’s Office.

Recommendation
1. Adopt a Resolution Dedicating a Portion of City-owned Land Located at the Southwest Corner of El Camino Real and Jackson Street for use as an underground electric easement [APN 269-03-131 (2017-18); SC 18,998]; and
2. Authorize the recordation of the Resolution.
