BACKGROUND

Sections 4 and 6 of the Personnel and Salary Resolution require City Council approval of new or revised classifications.  The proposed Council action satisfies these applicable requirements.

 

Various Modifications to Existing Classified Classifications

 

The Police Department coordinated with the Human Resources Department to modify the Recruit Police Officer (Job Code 689) and Police Officer (Job Code 650) classifications to incorporate revisions to the class specifications required under Assembly Bill 846 and Senate Bill 2, and to better align with the duties required to be performed.

 

The Fire Department worked with the Human Resources Department to revise the Firefighter I (Job Code 487) class specification to expand the minimum qualifications and update the classification to reflect current requirements of the job.

 

These modifications were approved by the Civil Service Commission on September 12, 2022.

 

DISCUSSION

 

Revise Recruit Police Officer (Job Code 689) and Police Officer (Job Code 650) Class Specifications

 

The Police Department coordinated with the Human Resources Department to revise the Recruit Police Officer (Job Code 689) and Police Officer (Job Code 650) classifications in order to align with revisions under Assembly Bill 846 and Senate Bill 2. 

 

Assembly Bill 846 updated Government Code §1031 to require agencies to review and revise class specifications and recruiting practices to emphasize community-oriented policing, community interaction, and collaborate problem-solving, as well as requiring officers to be free from any "emotional, or mental condition, including bias against race or ethnicity, gender, nationality, religion, disability, or sexual orientation, which might adversely affect the exercise of the powers of a peace officer."  Revisions under the Typical Duties and Knowledge, Skills, and Abilities incorporate these changes. 

 

Senate Bill 2 updates Government Code §1029. Senate Bill 2 requires a law enforcement agency to employ peace officers with a valid POST certification. It also disqualifies a person from employment as a peace officer if they have been convicted of, or have been adjudicated in an administrative, military, or civil judicial process as having committed, a violation of certain specified crimes against public justice, including the falsification of records, bribery, or perjury. The bill disqualifies any person who

has been certified as a peace officer by the Commission on Peace Officer Standards and Training and has surrendered that certification or had that certification revoked by the commission, or has been denied certification. The Minimum Qualifications section has been updated to require Police Officer candidates to possess a valid California Commission on Peace Officer standards and Training (POST) Basic certification. Revisions have also been made to the Licenses/Certifications section to clearly

identify to candidates the Government Codes they are subject to meet in order to qualify for employment as a Police Officer.

 

Administrative changes were made to the Class Summary and Distinguishing Characteristics sections for both classifications. 

 

Recruit Police Officer (Job Code 689) - with an annual salary range of approximately $105,048.72 - $134,157.24. This classification is an entry level, non-sworn position in the Police Department. Incumbents in the position are assigned to the Basic Peace Officer Academy and must satisfactorily pass all of the requirements that lead to the possession of the Basic Peace Officer Standards and Training Certificate before becoming candidates for the sworn position of Police Officer.

 

Police Officer (Job Code 650) - with an annual salary range of approximately $142,699.44 - $182,110.56.  This classification is a sworn position in the Police Department. Incumbents perform various law enforcement duties which impact public safety, including responding to calls for service and investigating complaints. Primary functions are patrol assignments where incumbents monitor and respond to calls for service to protect people, property, and enforce City, County, and State laws.

 

Revise the Firefighter I (Job Code 487) Class Specification

 

The Fire Department coordinated with the Human Resources Department to revise the Firefighter I (Job Code 487) to be in alignment with duties required to be performed by the classification.  The revisions include various administrative changes to update

the Class Summary and add the Distinguishing Characteristics section. The Licenses/Certifications section was updated to allow candidates who are enrolled in an

Emergency Medical Technician (EMT) program to participate in the recruitment process, in order to expand the candidate pool. The Typical Duties and Knowledge, Skills, and Abilities sections were also updated to accurately reflect the current requirements of the position.

 

Firefighter I (Job Code 487) - with an annual salary range of approximately $94,911.84 - $118,094.16 (Firefighter I - 24 Hours, Job Code 487S) and $93,279.48 - $116,063.04 (Firefighter I - 80 Hours, Job Code 487Y) - This classification is the entry level classification in the Firefighter series. An incumbent in this classification responds to medical emergencies, fire alarms, performs rescue services, and protects life and property endangered by fire. When qualified and assigned, Firefighter I's may be assigned to paramedic duties.

 

ENVIRONMENTAL REVIEW

The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental organizational or administrative activity that will not result in direct or indirect changes in the environment.

 

FISCAL IMPACT

There is no fiscal impact to revise class specifications.

This report has been coordinated with the Finance Department and City Attorney’s Office.
