SUBJECT
Title
PUBLIC HEARING: Action on a Tentative Parcel Map at 2360 Mission College Boulevard for the Creation of Three Lots
Report
COUNCIL PILLAR
Promote and Enhance Economic, Housing and Transportation Development
BACKGROUND
The applicant requests approval of a Tentative Parcel Map (File No. PLN23-00479) to subdivide the 6.4-acre property at 2360 Mission College Boulevard into three parcels to accommodate an existing office building, a new ancillary retail structure, and a common lot. This application follows a previously approved project (File No. PLN2007-06720) of two six-story office buildings, one six-story parking garage and a retail building.
Per Section 17.05.400 of the City Code, consideration and action on a Tentative Parcel Map is a function of the City Council. A recommendation from the Planning Commission is not required for minor subdivisions of four lots or less.
DISCUSSION
The Tentative Parcel Map proposes to subdivide one existing parcel into three condominium lots. The Council approved the Planned Development (PD) zoning for the two office buildings, one retail building, and one parking garage in 2009. To date, one office building and the parking garage have been built. At the time of the 2009 rezoning, the Council also approved a tentative parcel map, substantially similar to the current proposal, but that tentative map expired. The proposed subdivision will create one lot for the existing office building and one lot for the proposed retail building. The remainder of the property, with the parking structure, will be a common lot.
The proposed Tentative Parcel Map (Attachment 3) was reviewed by the City’s Subdivision Committee and determined complete for review by Council in accordance with Section 17.05.400(c) of the City Code on December 12, 2023. Staff has confirmed that the proposed subdivision will not result in any inconsistencies with the General Plan and zoning designations for the property, Building Code, or other applicable requirements. Conditions of Approval have been prepared and are provided as Attachment 2. The conditions include a requirement for recordation of Covenants, Conditions and Restrictions (CC&R’s) or equivalent instrument governing the shared use and maintenance of utilities, parking spaces (surface and garage), drive aisles, pedestrian walkways, trash, landscaping, and other related facilities.
Approval of the Tentative Parcel Map would allow the property owner flexibility in financing and/or leasing of the property, thereby supporting their long-term use consistent with policies and goals contained in the City’s General Plan.
ENVIRONMENTAL REVIEW
On April 21, 2009, the City Council certified an Environmental Impact Report (EIR) for the Project and adopted a statement of overriding considerations and a mitigation monitoring and reporting program, all of which anticipated the proposed subdivision. Since that time, there have been no substantial changes in the project or the circumstances under which the project is undertaken, and no new information of substantial importance has arisen, that would require major revisions of the EIR. Therefore, no additional environmental review is necessary.
FISCAL IMPACT
There is no cost to the City other than administrative staff time and expense for the processing of this application typically covered by processing fees paid by the applicant.
COORDINATION
This report has been coordinated with the City Attorney’s Office.
PUBLIC CONTACT
On January 24, 2024, a notice of public hearing was published in The Weekly, a newspaper of general circulation, and on January 25, 2024, notice of this item was posted in three conspicuous locations within 300 feet of the project site and mailed to property owners within 500 feet of the project site. At the time of this report, Planning staff has not received public comments regarding the proposed project.
Public contact was made by posting the Council agenda on the City’s official-notice bulletin board outside City Hall Council Chambers. A complete agenda packet is available on the City’s website and in the City Clerk’s Office at least 72 hours prior to a Regular Meeting and 24 hours prior to a Special Meeting. A hard copy of any agenda report may be requested by contacting the City Clerk’s Office at (408) 615-2220, email clerk@santaclaraca.gov <mailto:clerk@santaclaraca.gov> or at the public information desk at any City of Santa Clara public library.
