BACKGROUND
At the December 9, 2025, Council meeting, proposed Ordinance No. 2083 was passed for the purpose of publication. Pursuant to City Charter Sections 808 and 812, a summary of proposed Ordinance No. 2083 was published in the Santa Clara Weekly on December 10, 2025, and copies were posted in three public places.

DISCUSSION
The proposed ordinance establishes temporary regulations governing certain outdoor commercial activities within a designated Special Event Zone during major events at Levi's(r) Stadium, including Super Bowl LX and FIFA World Cup 2026. The ordinance applies only within the Special Event Zone and only during the defined Special Event Time Periods, as adopted by the City Council.

The ordinance does not alter or replace existing federal, state, or local requirements; all other applicable regulations including those governing counterfeit goods, temporary uses, and special event permits remain in effect.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of a California Environmental Quality Act ("CEQA") pursuant to the CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Even if adoption of the Ordinance was considered to be a project under CEQA, it would be exempt from CEQA review pursuant to CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that adoption of the Ordinance would have a significant effect on environment given that it does not involve or authorize any construction or...
