Action on Resolution Ordering the Vacation of an Underground Electric Easement at 3740 El Camino Real

BACKGROUND
In 2017, Chevron applied for a building permit to remodel and upgrade (Project) a gas station at 3740 El Camino Real. Due to the Project, the underground electric easement encumbering the property has been relocated or determined to be excess, and the existing easement is no longer necessary.
DISCUSSION
To clear the unnecessary encumbrance on the property, the property owner now requests that the City vacate this easement. Silicon Valley Power, the only agency having an interest in the easement, has agreed to the vacation.
ENVIRONMENTAL REVIEW
The Project is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15301, Existing Facilities.
FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.
COORDINATION
This report has been coordinated with Silicon Valley Power and the City Attorney’s Office.

Recommendation
1. Adopt a Resolution ordering the vacation of the underground electric easement at 3740 El Camino Real [APN 313-06-003 (2017-18); SC 19,043]; and
2. Authorize the recordation of the Resolution.
