BACKGROUND
The City's Architectural Review Committee approved the LS1 Data Center project (Project) located at 2215 Martin Avenue (Property) on September 18, 2019. The Project included demolition of an existing one-story office/warehouse building and associated surface parking, and construction of a new three-story data center. The data center building is approximately 80,000 square feet and includes a paved surface parking lot on 1.68 acres. On September 25, 2019, an appeal of the Architectural Review Committee's approval of the project was filed. On November 13, 2019, the Planning Commission held a public hearing on the appeal and adopted a resolution to deny the appeal, thereby upholding project approval.

DISCUSSION
Due to the redevelopment of the Property, the existing Electrical Easement, Wire Clearance Easement and Anchor Easement encumbering the Property have been relocated and are no longer necessary. The owner has requested that the City vacate the subject easements to clear these unnecessary encumbrances on the Property. Additionally, as these easements cross into the adjacent property at 2225 Martin Avenue, the Project coordinated vacation of the easements with the adjacent property owner who also consented to the vacation of the easements on their property.

Any relevant facilities previously within said easements or portions to be vacated have been removed or abandoned. All departments and agencies having an interest in the easements concur that the easements are eligible to be vacated.
