Title
Action on a Resolution Ordering the Vacation of a Sanitary Sewer and Storm Drain Easement, and Electrical Easement at 3077-3157 El Camino Real

Report
COUNCIL PILLAR
Promote and Enhance Economic, Housing, and Transportation Development

BACKGROUND
Toll Brothers (Owner) is currently in the process of redeveloping the property at 3077-3157 El Camino Real (Property) with 60 for-sale housing units arranged in eight 3-story building clusters (Project). The Project was approved by City Council on July 12, 2022.

DISCUSSION
Due to the redevelopment of the Property, the existing Sanitary Sewer and Storm Drain Easement encumbering the Property have been determined to be in excess and the existing Electrical Easement has been relocated; and the easements are no longer necessary. The owner has requested that the City vacate the subject easements to clear these unnecessary encumbrances on the Property. Any relevant facilities previously within said easements or portions to be vacated have been removed or abandoned. All departments and agencies having an interest in the easements concur that the easements are eligible to be vacated. Staff has reviewed this proposal and found that these easements are no longer necessary for public purposes and therefore recommend that they be vacated according to California Streets and Highways Code Section 8333(c).

ENVIRONMENTAL REVIEW
The potential environmental impacts of the Project were addressed in the Mitigated Negative Declaration prepared for the Project that was approved by Council on July 12, 2022.

FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

COORDINATION
This report has been coordinated with the City Attorney's Office, Silicon Valley Power, and the Water and Sewer Utilities Department.
