BACKGROUND
At the September 24, 2024 Council meeting, proposed Ordinance No. 2072 was passed for the purpose of publication. Pursuant to City Charter Sections 808 and 812, a summary of proposed Ordinance No. 2072 was published to the Santa Clara Weekly on October 16, 2024, and copies were posted in three public places.

DISCUSSION
The proposed ordinance would update Chapter 13.20 of the Santa Clara City Code to enable the City to comply with the City's Municipal Regional Stormwater National Pollutant Discharge Elimination System Permit 3.0 (MRP 3.0) issued by the California Regional Water Quality Board, San Francisco Bay Region. Updates to Santa Clara City Code Chapter 13.20 include stormwater management requirements for new and redevelopment projects, construction sites, industrial and commercial sites, and private land drainage areas. In addition, the changes to Chapter 13.20 include provisions that authorize the City to establish fees for stormwater related reviews, inspections, and compliance activities and enable City representatives to enter a regulated property to inspect, monitor, and collect samples in accordance with state and federal laws.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(a) as it has no potential for resulting in either direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

FISCAL IMPACT
There is no fiscal impact associated with this ordinance update.
