Action on Resolutions Ordering the Vacation of Underground Electric Easements for Various Properties

BACKGROUND
On May 22, 2012, Council approved the 3333 Scott Boulevard office building project totaling 735,000 square feet (Project) at 3535 Garrett Drive, 3315/3325 Scott Boulevard, and 2910/3000/3100 Tannery Way. Due to the redevelopment of the property, the underground electric easements encumbering the property have been relocated or determined to be excess, and the existing easements are therefore no longer necessary.
DISCUSSION
To clear the unnecessary encumbrance on the property, the property owner now requests that the City vacate these easements. Silicon Valley Power, the only agency having an interest in the easements, has agreed to the vacation.
ENVIRONMENTAL REVIEW
The potential environmental impacts of the Project were addressed in the Environmental Impact Report prepared for the Project and was approved by Council on May 22, 2012. Subsequently, on June 10, 2015, the Planning Commission approved the Supplemental Environmental Impact Report.
FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

This report has been coordinated with Silicon Valley Power and the City Attorney's Office.
