BACKGROUND
On November 8, 2013, the Architectural Committee approved the construction of a 20,219 SF office building (Project) at 2690 Scott Boulevard (Property) for Botham Construction (Owner). The Project was conditioned to vacate the existing electric and wire clearance easements on the Property as they conflict with the new building footprint. A conditional building permit release was issued on November 8, 2013 to allow for the issuance of the building permit with the condition that the easement be vacated prior to final building inspection or occupancy. For reasons unknown, the building permit was finalized, and the easements were not vacated. The Owner completed the construction of the Project in 2014 and a new underground electrical easement was dedicated to serve the site. On November 1, 2021, the Owner reached out to the City to request the outstanding easement be vacated as a cleanup item for their property.
DISCUSSION
Due to the redevelopment of the Property, the existing electric easement and wire clearance easement encumbering the Property have been relocated or determined to be excess, and these easements are no longer necessary. The Owner has requested that the City vacate the subject easements to clear these unnecessary encumbrances on the Property. Any relevant facilities previously within said easement have been removed or abandoned. Silicon Valley Power, the only agency having an interest in the easements, concurs that these easements are eligible to be vacated. Staff has reviewed this proposal and found that these easements are no longer necessary for public purposes and therefore recommend that they be vacated according to subsection C of California Streets and Highways Code Section 8333.
