BACKGROUND
Historically, the prior Memoranda of Understanding (hereafter, "MOU") between the City of Santa Clara (hereafter, "City") and the Santa Clara Police Officers Association (Unit 2) (hereafter, "Unit 2") have described the holiday pay for employees in classifications represented by Unit 2. Recently, the California Public Employees' Retirement System (hereafter, "CalPERS") requested historical clarification as to how holiday pay was calculated and paid, and that such clarification be memorialized in a resolution.

DISCUSSION
CalPERS has requested clarification as to how the holiday pay was determined in the MOU between the City and Unit 2 from 2021 to 2025.

The holiday pay language in the 2021-2025 Unit 2 MOU is as follows:

"The number of hours per year for holiday pay is 104 hours (equivalent to 13 days based on eight (8) hours per day) for all represented employees.

Effective the first full pay period after ratification by Association membership and approval by City Council of this MOU, employees shall receive approximately 7.5% as holiday-in-lieu compensation."

The language shall be updated to the following to clarify its intent:

Effective the first full pay period after ratification by Association membership and approval by City Council of this MOU (6/12/2022), employees who are normally required to work on an approved holiday because they work in positions that require scheduled staffing without regard to holidays shall receive Holiday Pay as follows:

Employees shall be provided holiday-in-lieu compensation for the following 13 annual paid holidays:

* New Year's Day
* Martin Luther King Jr. Day
* Presidents' Day
* Spring Holiday
* Memorial Day
* Independence Day
* Labor Day
* Admission Day
* Indigenous People's Day
