BACKGROUND
On December 2, 2008, City Council approved the development agreement with Nvidia to redevelop the property at 2788 San Tomas Expressway by removing all buildings and constructing new buildings. Subsequently, Amendment 1 to the development agreement was approved by Council on July 16, 2013.

DISCUSSION
Due to the redevelopment of the property, the underground electric easements, water utility easements, and sanitary sewer easements encumbering the property have been relocated or determined to be excess, and the existing easements are therefore no longer necessary. To clear the unnecessary encumbrance on the property, the property owner now requests that the City vacate said easements. All departments having an interest in said easements have agreed to the vacation of the easements. A Resolution ordering the vacation of said easements is attached.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

This report has been coordinated with the Finance Department and City Attorney's Office.
