BACKGROUND
On March 8, 2016, Council awarded the Sewer Pump Station, Lift Station and Well Site Equipment Upgrades Project to Anderson Pacific Engineering Construction, Inc. for a not-to-exceed amount of $548,900.00. The Project included the replacement of the existing motor control centers (MCCs) and installation of new variable frequency drives (VFDs) at the Northside Sewer Pump Station and Rabello Sewer Pump Station; installation of new electrical utility services at the Northside Sewer Pump Station and Guadalupe Chart Recording Station; a new SCADA control panel equipment at Guadalupe Chart Recording Station; and new automatic transfer switches and controls at De La Cruz Sewer Lift Station and four groundwater water well sites.

The acceptance of a Project and filing of a Notice of Completion is one of the final steps in a public works project. The attached Notice of Completion contains the required elements set forth in Civil Code ? 8102. Recording the Notice is authorized by statute, Civ. Code ? 9204, and by recording the Notice within 15 days of acceptance, the City shortens certain statutes of limitations related to the Project, such as the time for filing mechanics liens and stop payment notices, thereby limiting the City's potential liability. Acceptance of the project will also allow for the release of retention payments to the contractor (Pub. Cont. Code ?? 7107(c)(2), 9203(a)).
DISCUSSION
All work in connection with the referenced Project has been completed in accordance with the Project plans and specifications and to the satisfaction of the City.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Act ("CEQA") pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the env...
