BACKGROUND
The Black Butte Re-Regulation Basin Erosion Repair Project (Contract No. 2416) consisted of the repair of the bank erosion at the Black Butte hydroelectric plant and was required to comply with Federal Energy Regulatory Commission (FERC) regulations. The contractor, Anderson Dragline, Inc., completed all the work under the contract. The Project had a final price of $2,269,658.02.

DISCUSSION
Provisions of the contract with Anderson Dragline, Inc. allowed for a 2.5% retention to insure the contract was satisfactorily completed. Anderson Dragline, Inc. has completed all of the provisions of the contract to the satisfaction of the City. Acceptance of the work as completed and authorization for the recordation of the Notice of Completion will allow for the thirty five (35) day retention release period to begin.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

COORDINATION
This report has been coordinated with the Finance Department and City Attorney's Office.
