Action on an Ordinance Including Elected Chief of Police in Salary Setting Commission’s Regular Review of Elected Officials’ Compensation

BACKGROUND

Charter Section 702 establishes a Salary Setting Commission that will set the compensation for the Mayor and Council beginning in 2019 and every two years thereafter. On July 17, 2018, Council adopted Ordinance No. 1983 which in part established that the Elected City Clerk’s monthly stipend will be set by the Salary Setting Commission beginning in 2019.

 

Pursuant to Council’s direction on August 21, 2018, the attached ordinance’s purpose is to include the Elected Chief of Police as part of the Salary Setting Commission’s regular review and setting of City elected officials’ compensation beginning in 2019, in order to align compensation setting and modification for all elected officials of the City.

 

DISCUSSION

Pursuant to Council direction, this report provides an ordinance for first reading establishing that the Salary Setting Commission will set the salary for the Chief of Police, as it will do for the other elected positions of Mayor, Council Members, and City Clerk.  If approved by Council, commencing on July 1, 2019, and every two years on July 1 thereafter, the compensation of the Chief of Police will be set by the Salary Setting Commission consisting of five members to be appointed by the Civil Service Commission, as set forth in City Charter Section 702.

 

ENVIRONMENTAL REVIEW

The action being considered does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental organizational or administrative activity that will not result in direct or indirect changes in the environment.

 

FISCAL IMPACT

There is no fiscal impact related to this report other than administrative staff time and expense.

This report has been coordinated with the City Attorney’s Office.

RECOMMENDATION

Recommendation

Approve the introduction of an Ordinance adding a new Section 2.80.015 (“Chief of Police - Compensation”), of Chapter 2.80 (“Police Department”) of Title 2 (“Administration and Personnel”) of “The Code of the City of Santa Clara, California” which will include the Elected Chief of Police as part of the Salary Setting Commission’s regular review and setting of City elected officials’ compensation beginning in 2019.
