BACKGROUND
Koll/Intereal Bay Area ("Owner") is currently in the process of constructing the Mission Park Market Place project ("project"), which includes a 24,000 square foot retail center and a 175-room hotel at 2041 Mission College Boulevard. On July 27, 2016, the Owner obtained a Use Permit for the project from the Planning Commission and on October 11, 2016, City Council approved the Tentative Parcel Map for the project. Due to redevelopment of the property, the general purpose easement, utility easement, underground electric easement, and anchor easement encumbering the property have been relocated or determined to be excess, and are no longer necessary.

DISCUSSION
To clear the unnecessary encumbrance on the property, the Owner now requests that the City vacate said easements. Silicon Valley Power, PG&E, and AT&T, the agencies having an interest in the easements, have agreed to the vacations. Staff has reviewed this proposal and finds that these easements are no longer necessary for public purposes.

ENVIRONMENTAL REVIEW
The potential environmental impacts of the project were addressed in the Mitigated Negative Declaration prepared for the project and was approved by the Planning Commission on July 27, 2016.

FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

COORDINATION
This report has been coordinated with the Water and Sewer Department, Silicon Valley Power (Electric Department), and the City Attorney's office.
