BACKGROUND
The President and Board of Trustees of Santa Clara College ("Owner") is currently in the process of constructing an approximate 273,429 square foot STEM building project within the Santa Clara University Campus at 500 El Camino Real. A portion of this building is proposed to be constructed within an existing public utility easement. Due to redevelopment of the property, the public utility easement encumbering the property has been relocated or determined to be excess, and is no longer necessary.

DISCUSSION
To clear the unnecessary encumbrance on the property, the Owner now requests that the City vacate said easement. Silicon Valley Power, PG&E, and AT&T, the agencies having an interest in the easements, have agreed to the vacation. Staff has reviewed this proposal and finds that this easement is no longer necessary for public purposes.

ENVIRONMENTAL REVIEW
The potential environmental impacts of the project were addressed in the Certified EIR (CEQ2014-01184) prepared for the approved Santa Clara University Five-Year Master Plan and Use Permit approved by the Planning Commission on July 27, 2016.

FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

COORDINATION
This report has been coordinated with the City Attorney's Office, Silicon Valley Power (Electric Department), and the Water & Sewer Utilities Department.
