BACKGROUND
On January 12, 2016, City Council approved the rezoning for the Santana Terrace Senior Apartments Project (Project) at 190 N. Winchester Boulevard (Property). The property owner is currently in the process of constructing the Project, which includes two four-story buildings with a total of 92 apartment units on a 1.86-acre site.

DISCUSSION
Due to the redevelopment of the Property, the existing electric easements encumbering the Property have been relocated or determined to be in excess, and these easements are no longer necessary. The owner has requested that the City vacate the subject electric easements to clear these unnecessary encumbrances on the Property. Any relevant facilities previously within the easements have been removed or abandoned. Silicon Valley Power, the only department having an interest in the easements, concurs that these easements are eligible to be vacated. Staff has reviewed this proposal and found that these easements are no longer necessary for public purposes and therefore recommends that they be vacated according to subsection C of California Streets and Highways Code Section 8333.

ENVIRONMENTAL REVIEW
The Mitigated Negative Declaration prepared for the Project was approved by the City Council on January 12, 2016.

FISCAL IMPACT
There is no additional cost to the City other than staff time and expense.

COORDINATION
This report has been coordinated with the City Attorney's Office and Silicon Valley Power.
