BACKGROUND

The Central Park Arbor Center Playground is a small, 1960’s era, metal, wood and natural stone play space that was identified in the 2017 Parks & Recreation Facility Condition Assessment as in “critical” condition and in need of replacement as well as being identified in the Central Park Master Plan as the location for an expanded, all ages and abilities community serving playground. On January 12, 2021, after extensive community outreach and recommendation from the Parks & Recreation Commission, Council approved the preferred schematic design (Project) and Ordinance No. 2028 (Measure R compliance).

 

The Project is to be funded through Capital Improvement Program funds from a variety of sources: City in the amount of $1.8 million from Developer Contributions and Mitigation Fee Act in Lieu fees, County of Santa Clara All Inclusive Playground Grant funds  in the amount of $1.765 million, and funds to be raised by the Magical Bridge Foundation through individual, community and corporate support. Given construction cost escalation and continued desire to fund a complete playground experience, the City sought and secured additional grant funding. In June 2022, the City was awarded State funds requested by California Assembly Member Alex Lee. In particular, the focus of the State Grant funds was to support the Project’s Scope of Work C "Additional/Alternate Playground Elements” inclusion of the hilltop area improvements, laser harp, sway boat, renovation of the amphitheater, “Look Out” balcony, and adult fitness stations.

 

DISCUSSION

The AB-179 Budget Act of 2022, section 19.56, B, 16, C awards $800,000 to the City of Santa Clara for the Magical Bridge All-Inclusive Playground in Central Park in the form of a Specified Grant. The State of California Grant program requires City adoption of a Resolution (Attachment 1) in order to submit a project application and to receive funds. Grant funds are to be used towards the playground items specified in Scope C as explained above. The Resolution confirms that the City has the funding to complete, operate and maintain the Project as noted below in the Fiscal Impact section of this report, and, if approved, will authorize the City Manager to administer the Grant.

 

ENVIRONMENTAL REVIEW

The action being considered, adoption of a Resolution for the acceptance and allocation of funds, does not constitute a “project” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15378(b)(5) in that it is a governmental organizational or administrative activity that will not result in direct or indirect changes in the environment.

 

FISCAL IMPACT

The Central Park Arbor Playground Project in the Parks and Recreation Capital Fund has a current, remaining budget of $3,720,500. Current park maintenance activities are included in the City’s Parks & Recreation annual Operating Budget.

 

The State Grant appropriates new funding in the amount of $800,000 to increase the current project budget from $3,720,500 to $4,520,500. Any construction funding gaps will be requested from unallocated Park In-Lieu Fees at award of construction Bid, expected in early 2023.

RECOMMENDATION

Recommendation

1.                     Adopt a Resolution Delegating Authority to the City Manager to Execute all Documents Associated with State of California Local Assistance Specified Grant;

2.                     Approve the FY 2022/23 budget amendment to appropriate the State of California Local Assistance Specified Grant in the Parks and Recreation Capital Fund and increase the project appropriation by $800,000 (five affirmative Council votes required to appropriate additional revenue).
