BACKGROUND
On October 2, 2017, Council approved an agreement with YEI Engineers, Inc. (YEI) to provide engineering services for Citywide Emergency Generator Replacement - Phase 1 (Project) for public works bidding (Attachment 1). The agreement expires on December 31, 2020.

On August 18, 2020, Council awarded the Construction Contract for the Project to the lowest responsible and responsive bidder, Rosendin Electric, Inc.

DISCUSSION
The remaining tasks for YEI include providing support services during the Construction and Post-Construction Phases of the Project which is estimated to be completed in late 2021. The Project's estimated construction completion date is December 2021, however this timeframe is subject to change based on the current issues related to the COVID-19 pandemic. Since the agreement expires in the next few months and construction will not be completed, an amendment to extend the term is needed.

The proposed Amendment No. 1 attached to this report (Attachment 2) extends the contract time to the completion of work described in Exhibit A - Scope of Services of the Agreement. Staff recommends approval of Amendment No. 1 to the Agreement for YEI so the remaining tasks in the Agreement can be completed.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(a) as it has no potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

FISCAL IMPACT
